NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated April 12, 2001, executed by Borrower(s), David E Keener Jr and Tracy J Keener, to W. Brad Sorelle, the Trustee of record in the office of the Clerk of the County Commission of Marion County, West Virginia, in Book 706, at Page 509. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 25 Graceful Ln, Rivesville, WV 26588. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 8, 2017, of record in the Clerk’s Office in Book 1183, Page 645. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Marion County, in Fairmont, West Virginia, on the following date:
April 15, 2021 at 1:32 P.M.
All that certain parcel of real estate, situate, lying and being in the Newcamp Addition to the town of Rivesville, (but outside the corporate limits of said town) in Paw Paw District, Marion County, West Virginia, a map or plat of which Addition is of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book No. 330, at page 3, the same being more particularly bounded and described as follows:
All of the following part of Lot 10, Block 2 of the Newcamp Addition as shown on a plat recorded in Deed Book 330, at page 3, situate in Paw Paw District, Marion County, West Virginia, and more particularly bounded and described as follows:
BEGINNING at 1/2” iron pin set on the eastern right of way limits of Potter Avenue, corner to Lots 10 & 11; thence with the eastern right of way limits of Potter Avenue, North 4° 15` West 49.26 feet to a 1/2” iron pin set at the intersection of Potter Avenue with Moore Avenue; thence with the southern right of way limits of Moore Avenue, North 54° 22` 30″ East 26.71 feet to a 1/2” iron pin set; thence leaving Moore Avenue and running with two arbitrary lines through Lot 10, South 41° 18` 21″ East 37.88 feet to a 1/2″ iron pin set; thence North 86° 41` East 54.37 feet to a 1/2” iron pin set on the western right of way limits of a 16 foot alley; thence with the western right of way limits of said alley, South 4° 15` East 33.68 feet to a 1/2″ iron pin set, corner to Lots 10 & 11: thence with one line of Lot 11, South 86° 41` West 100 feet to the place of beginning, containing 0.10 acres, more or less, and as set forth on a plat of survey prepared by Paul D. Harbert, P.S. No. 862, dated March, 2001, and which is attached hereto and incorporated herein for all pertinent purposes.
Being the same property conveyed to David E Keener Jr and Tracy J Keener by the Deed dated April 12, 2001 and recorded in Deed Book 968 at Page 68 in the Office of the Clerk of the County Commission of Marion County, West Virginia.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
