NOTICE OF TRUSTEE'S SALE

NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated December 29, 2014, executed by Borrower(s), Michael W Giles, to Gary R. Mills, the Trustee of record in the office of the Clerk of the County Commission of Fayette County, West Virginia, in Book 942, at Page 604. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 288 Sowder Ln, Pax, WV 25904. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated December 16, 2025, of record in the Clerk's Office. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Fayette County, in Fayetteville, West Virginia, on the following date:

13th day of March, 2026
at 12:05 p.m.

Those tracts or parcels of land, together with the improvements thereon and easements thereto and the appurtenances thereon or belonging thereto, and more particularly bounded and describes as follows: TRACT ONE: A certain boundary of land situated on Paint Creek, Plateau District, Fayette County, West Virginia, and being a part of F.O. Davis Tract. PARCEL ONE: BEGINNING at a corner in bend of Paint Creek, corner to F. 0. Davis Tract, and being part of said tract, and running a tie line to same; S 34 degrees E 320 feet to a stone, this being the Northwest corner of George W. Davis Lot; thence N 75 degrees E 180 feet to a stone; S 41-25 E 51 feet to a stone; S 43-30 W 170 feet to a stone; N 58-50 W 113 feet to a stone; N 00-30E 68 feet to the beginning, containing 45/100 of an acre. PARCEL TWO: BEGINNING at an Ash on bank of Paint Creek, this being a corner of what is known as the Ashley-Tyree Tract. Thence up Paint Creek with F.O. Davis line S 10'-00" E 231 feet, thence leaving and running through F.O. Davis tract S 34 degrees E 370 feet to corner of George W. Davis tract, and with same N 75-00'E 180 feet to a stone, thence leaving George W. Davis tract and through F.O. Davis N 79-15' E 283 feet to a poplar in field, thence N 52-45' E 201 feet to a stone, N 42-25' E 175 feet to a beach on hill side, N 27-10' W 314 feet to corner in original line on ridge and with same S 75-30' W 212 feet to a poplar on point, S 85-30' W 718 feet to beginning and containing 9 1/4 acres, more or less. And being the same property conveyed unto Webard Development, LLC, by Deed dated the 27th day of September, 2012, from Andrew D. Weber, which Deed is of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 686, at Page 217; and conveyed unto Michael W. Giles, by Deed dated the 23rd day of December, 2014, and recorded in Clerk's office in Deed Book 717, at Page 593. This conveyance is made and accepted subject to all reservations, exceptions, limitations, restrictions and conditions contained in all former conveyances of said property or any part thereof, except those pertaining to race, color, or creed.

TERMS OF SALE:

1)The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property.

2)The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code §11-22-1.

3)The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4)The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5)The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6)The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale
