NOTICE OF TRUSTEE'S SALE

PUBLIC AUCTION

In execution of a certain Deed of Trust dated April 11, 2023, recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Trust Deed Book 1080, at page 41, given by Herman M. Stevenson, Ill, to Paul 0. Clay, Jr., and Denise A. Light, Trustees for Fayette County National Bank, default having been made in the payment of the debt therein secured; and upon failure to cure said default; and being required by the beneficiary so to do, the undersigned Trustee will sell at public auction at the front door of the Courthouse of Fayette County, Fayetteville, West Virginia, on Thursday February 12th, 2026, at 10:00 o'clock a.m., the following described real estate situate in the City of Oak Hill, Fayette County, West Virginia, and being more particularly bounded and described as follows, to-wit

TRACT NO 1: Beginning at an iron fence post 56.5 feet from the center of the front yard gate, and running S 62-13 E 60 feet to a stone on a brink of rock, thence S 40-40 W 65 feet to a set stone, thence N 62-13 W 60 feet to the lower edge of an alley, thence with the said alley N 40-40 E 65 feet to the beginning, containing thirty-nine hundred (3900) square feet.

TRACT NO 2: Beginning at a locust hub on the Woods line, at lower side of alley 14 feet east of Pentecostal Holiness Church Lot 6, 6 feet southeast of 12" black oak, and running with said alley N 1-45 E 84 feet to a locust hub opposite McMillion's comer N 16-30 E 49.5 feet, N 34-30 E 99 feet to Blake's corner, thence leaving said alley and with Black S 55-30 E 25 feet to an iron pin marker in edge of large rock, thence along said rock N 40-40 E 139 feet to an iron pin marker, thence N 55-30 W 19 feet to edge of said alley, thence with same N 40-40 E 95.5 feet to a set stone corner to Jack Harris lot, thence leaving alley and with Harris S 62-13 E 60 feet to a set stone, thence N 40-40 E 65 feet to a new line, thence leaving Harris and with new line S 62-13 E 179 feet to an iron pin in Hawkins line, thence with Hawkins S 41-30 E 362 feet to Hawkins and Huddleston corner at a fallen black oak, thence with the Huddleston line S 84-30 W 230.5 feet to the beginning, containing two acres, more or less.

Excepting and reserving from Tract No Two the following out-conveyances of real property conveyed unto Frederick W. Neudek by Deed dated the 15th day of August, 1968, from George B. Webb and Dolly V. Webb, containing 1.125 acres, said Deed is of record in the Office of the County Commission, Fayette County, West Virginia, in Deed Book 279, at Page 626.

And being the same property conveyed to Herman M. Stevenson, Ill, by deed of Clastic Rock, LLC, dated April 11, 2023, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 837, at page 4.

The above described real estate will be conveyed by the undersigned Trustee to the purchaser thereof by deed containing a covenant of SPECIAL WARRANTY and subject to all liens, reservations and exceptions appearing in the record title, and to the lien of all unpaid taxes, if any, which are entitled to priority over the lien of the aforesaid Deed of Trust.

The Trustee herein asserts, to the best of his knowledge and belief, that the party in interest is not a member of the Armed Forces of the United States, and is therefore not entitled to the benefits of the Service Members Civil Relief Act.

REAL ESTATE TAXES:
Subject property will be sold by the undersigned Trustee subject to real estate taxes presently a lien against subject real property. Any purchaser shall purchase subject to, and be responsible for, said real estate taxes.

TERMS OF SALE:
Cash on hand on day of sale. The above described real estate will be sold by the undersigned Trustee by auction to the highest bidder subject to the right of the Trustee to reject all bids if in his opinion they are inadequate. The owner of the indebtedness secured by the above described Deed of Trust and the owners of any other interest in the property to be sold shall have the right to bid.
The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and ny buyer is advised to retain counsel before the sale.

CONTINUANCE OR
ADJOURNMENT OF SALE:
The Trustee reserves the right to continue the sale, or to adjourn the sale, for a time, or from time to time, without further notice and announcement at the time and place of sale, as hereinabove set forth, or any continuance or adjournment thereof.
