Pursuant to the authority vested in the undersigned by deed of trust dated the 16th day of January 2015, signed by Tracey Earlington, to David G. Palmer, Trustee, which said deed of trust is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Trust Deed Book 1855, at page 211;

and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 11:30 o’clock A.M. on the

at the front doors of the Courthouse in Wood County in Parkersburg, West Virginia the following described real estate:

 

TRACT ONE: This is a parcel of land at the corner of 25th and Elm St., Tax map parcel 55-A1 consisting of .336 Ac. more or less shown on a plat made by James L. DeBrular of record in Deed Book 875 at Page 272; otherwise described in prior deeds and trust deeds as

 

Beginning at the northeasterly corner of the intersection of Elm Street and 25th Street; thence in a Northerly direction and with the Easterly line of Elm Street, 100 feet to a point; thence at right angles and in an easterly direction, 150 feet to the westerly line of Ray A. Wyland lot; 103 feet to the Northerly line of 25th Street; thence in a westerly direction and with the northerly line of 25th Street; thence in a westerly direction and with the northerly line of 25th Street, 150.4 feet to Elm Street, to the place of beginning, being Lot 9 (see plat book 14, page 45A).

 

This is EXCEPTED and RESERVED from the above conveyance that certain parcel of land conveyed by Allen M. Zigler and Wanda L. Ziegler; husband and wife, to William E,. Kiger, by Deed daed the 4th day of August, 1988, of record in the aforesaid Clerk’s Office in Deed Book 875, Page 270, bounded and described as follows:

 

Beginning at a point on the North side of 25th Street Extension, which said point is a common corner of the real estate conveyed herein and the property now owned by Thomas; thence North 40õ 54’ West18.47 feet to a point; thence North 43õ 31’ 29ã West a chain distance of 91.22 feet to a point; thence North 33õ 35 East 102.91 feet to a point, thence South 58õ 30’ East 102 feet to a point, another common corner with Thomas; thence South 31õ 30’ West 132 feet to the place of beginning.

 

This exception being all of Lot No. 10 and a portion of Lot No. 9 as shown upon a map of Mrs. C.M. Boger’s Tract and Extension of 25th Street, dated February 27, 1939, made by L.G. Merrill, Civil Engineer, and of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book 14, at page 45A. Reference is also made to a plat prepared by James L. DeBrular, LLS, dated July 14, 1988, a copy of which is of record in Deed Book 900, Page 842.

Harris; thence southerly and parallel with Latrobe Street, 70.77 feet to the northerly line of 23rd Street; thence with the northerly line of 23rd Street in a westerly direction, 43 feet, more or less, to the place of beginning. TRACT THREE: Beginning at a point in the northerly side of Twenty-Third Street, 43 1/2 feet easterly from Latrobe Street; thence in a northerly direction 70.77 feet to a point in the southerly line of Lot No. 14; thence with the southerly line of said Lot No. 14 in an easterly direction 37 feet to a point; thence in a southerly direction and parallel with Latrobe Street 70.77 feet to Twenty-Third Street; thence in a westerly direction 37 feet to the place of beginning, and being a portion of Lots Nos. 15 and 16 of the Thanhouser Addition to the City of Parkersburg, West Virginia, fully described in a plat of said Addition.

INCLUDED IN THIS SALE; is all of the inventory, equipment, accounts and other rights to payment, instruments and chattel paper, general intangibles, government  payments and programs, investment property, and deposit accounts which is collateral property used in connection with a store operation otherwise known as Traceys Market as described in connection with two separate security agreements and UCC financing statements filed with the Secretary of State of West Virginia and also recorded in the County Clerk’s office in Volume 13-30 and Volume 13-32.

 

It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust.

TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees.

Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder.

Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as Trustee by instrument of record.
