NOTICE OF TRUSTEE’S SALE

 

NOTICE IS HEREBY GIVEN that, default having been made in the payment of the indebtedness secured by the deed of trust hereinafter described, and the undersigned having been required so to do by the owner and holder of said indebtedness, the undersigned Substitute Trustee {see General Lien Book No. 1949, at page 357 thereof} will offer for sale at the front door of the Wood County Courthouse, Parkersburg, West Virginia, on

 

FRIDAY, FEBRUARY 3, 2017, at 10:00 o’clock in the forenoon, local time,

 

at public auction, to the highest bidder for cash, all of the right, title and interest of MICHAEL G. JOHNSON and AMBER D. JOHNSON in and to the real property described in a certain deed of trust dated July 10, 2012, to ALVIN H. PHILLIPS, Trustee, recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in General Lien Book No. 1711, at page 632 thereof, possessed by the said MICHAEL G. JOHNSON and AMBER D. JOHNSON as at the making of said deed of trust, which said real property is described in said deed of trust as follows, to-wit:

A parcel of land State of West Virginia, County of Wood, City of Parkersburg South of Rayon Drive, East of 9th Avenue, Beginning at A 1ã bar found corner to John Bosley Enterprises Deed Book 1036, page 310 and in the line of Rayon Drive with the line of an out parcel, Thence S 08 59 15 E 84.98 feet to a #5 rebar set, Thence N 89 11 07 W 99.26 feet to a #5 rebar set in the line of 9th Ave, with the line of 9th Ave Thence N 06 15 59 W 74.91 feet to a #5 rebar set in the line of Rayon Drive, Thence N 85 06 21 E 95.50 feet to the point of BEGINNING.

 

BEING 7694.3 Sq Ft of land, Wood County Habitat for Humanity Deed Book 1175, page 447 Plat Book 2A page 134. Records of the County Clerk of the County Commission of Wood County, West Virginia.

 

Subject to all right of way of record.

 

Survey and description by J. Edward Huffman, West Virginia Professional Surveyor No. 631 and as shown on plat JEH 20120220 a part of this record,

 

Property known as: 4403 9th Avenue, Parkersburg, WV 26101, upon the following terms, to-wit:

 

  1. Successful bidder must pay $2,500.00 at the time of the sale as non-refundable deposit, with the balance due by the close of business on the day of sale, or as the Trustee and bidder(s) may otherwise agree.

 

  1. Subject to any and all reservations, exceptions, conditions, grants of rights of way and easements made by the grantor and his predecessors in title prior to the granting of the deed of trust being foreclosed upon.

 

  1. The undersigned reserves the right to adjourn the sale from day to day and time to time upon oral proclamation made at the time and place of sale set forth herein or at such later time and place to which the sale has theretofore been adjourned.

 

  1. The undersigned reserves the right to reject any and all bids.

 

  1. Sale is subject to unpaid ad valorem taxes and special assessments, if any, as well as any sale of the subject real estate for unpaid taxes.

 

  1. The premises described hereinabove, including any and all improvements thereto, are sold âAS IS-WHERE ISã with no warranty express or implied.

 

  1. The owner and holder of the indebtedness secured by the deed of trust described hereinabove reserves the right to bid at this sale.

 

  1. The successful buyer at the sale will be responsible for paying any and all transfer stamps, excise fees and recording costs with respect to the trustee’s deed.

 

  1. Neither the owner and holder of the indebtedness secured by the underlying deed of trust nor the substitute trustee shall have any duty to cause any existing tenant or person or persons occupying the subject property to vacate said property.

 

  1. Any personal belongings remaining in the subject premises after sale shall be deemed abandoned and may thereafter be disposed of at the successful bidder’s or bidders’ discretion. Any person or entity claiming ownership of or any interest in any such property should contact the undersigned prior to sale about any such claim.

 

  1. The successful bidder at the sale and the Trustee shall execute a Memorandum of Sale at the conclusion of the sale, and the terms of the Memorandum shall control.

 

  1. In the event that the successful bidder at the sale fails or refuses to consummate his, her, its or their purchase, then the Trustee shall have the option to consummate sale with the next highest bidder at the sale.
