TRUSTEE’S SALE

Under authority of that certain Deed of Trust dated November 4, 2015, from Tracy D. Steinbrecher, n/k/a Tracy D. Pennington, to Marc B. Lazenby, Trustee, of record in the office of the Clerk of the County Commission of Pendleton County, West Virginia in Trust Deed Book No. 150, at page 344, securing a promissory note in the principal amount of $86,249.65, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Trustee will offer for sale at the front door of the Pendleton County Courthouse in Franklin, West Virginia on September 1, 2017 at 11:00 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, a tract of land, together with improvements thereon and appurtenances thereunto belonging, located at the southwest intersection of West Virginia Pendleton County Routes 5/2 and 28/1, situate on the waters of Shafter Run a tributary of the north fork of the Potomac River, in Union District, Pendleton County, West Virginia, more particularly described as follows:

Beginning at a point on the west right-of-way line of said Route 28/1 having a coordinate based on the west state plane system NAD 83, north zone northing of 696730.0 and an easting of 2444391.2 corner to at tract owned by Jill Whitman Trustee recorded in Deed Book 163 at page 667 and corner to the Tracy C. Steinbrecher tract recorded in Deed Book 173 at page 524 from which a water well bears N 29 degrees 09’ W. 207.54 feet; thence leaving said Route 28,1 and with said Whitman and Steinbrecher tracts for four calls; 1. N 68 degrees 02’ W crossing at 4.34 feet a 5/8 inch rebar with cap set at a fallen fence post in all 50.47 feet to a 5/8 inch rebar with a cap set in the old fence line; 2. N 75 degrees 24’ W 297.00 feet to a 5/8 inch rebar with a cap set at a fallen fence post; 3. N 05 degrees 34’ W. 98.80 feet to a 5/8 inch rebar with a cap set at the base of a 6 inch white oak; 4. N 21 degrees 10’ E 118.75 feet to a 5/8 inch rebar with a cap set on the south right-of-way line of said Route 5/2; thence leaving said Whitman tract and with the south right-of-way line of said Route 5/2 for two calls: 1. S 78 degrees 18’ E 180.35 feet to a point; 2. S 73 degrees 31’ E 200.20 feet to a point at the intersection of the south right-of-way line of Route 5/2 and the west right-of-way line of Route 28/1, from which an angle iron found corner to tract owned by Shon Harper recorded in Deed Book 135 at page 655 and Calvin Thompson recorded in Deed Book 167 at page 343 bears S 71 degrees 29’ E 32.79 feet; thence leaving said Route 5/2 and with the west right-of-way line of said Route 28/1 S 17 degrees 54’ W 220.27 feet to the place of beginning containing 1.87 acres more or less, as surveyed by PVE Sheffler and shown on a map entitled “PLAT OF SURVEY SHOWING A 1.87 ACRE+- TRACT FOR TRACY D. STEINBRECHER LOCATED AT HC 59 BOX 2050 CABINS, WV 26855 SITUATE ON THE WATERS OF SHAFTER RUN A TRIBUTARY OF THE NORTH FORK OF THE POTOMAC RIVER, UNION DISTRICT, PENDLETON COUNTY, WEST VIRGINIA, DATE: SEPTEMBER 10, 2015”.

Being the same property conveyed from Eugene M. Steinbrecher to Tracy D. Steinbrecher by Deed dated October 3, 2006, of record in the aforesaid Clerk’s office in Deed Book No. 173, at page 524.

Terms of the sale: cash on date of sale.
