ORDER OF PUBLICATION
The object of the entitled action is for the Plaintiff to obtain a judgment to reimburse it for its costs to demolish an unsafe structure upon real estate which is owned by the said Defendants herein or in which said Defendants claim liens in the premises located at 643 Hill Street Parkersburg, West Virginia 26101 with legal descriptions as follows to wit:
All that certain lot, tract or parcel of land, situate, lying and being in the District of Parkersburg, County of Wood and State of West Virginia, more particularly bounded and described as follows:
Beginning at the northwesterly corner of the intersection of Power Avenue and Hill Street; thence with the northerly line of Hill Street, S. 85 deg. 30’ W. 225 feet to a point; thence in a northeasterly direction with the easterly line of a proposed street (now called Anne Avenue) 124 feet to a point; thence in an easterly direction parallel with the northerly line of Hill Street, 183 feet to the westerly line of Power Avenue in a southerly direction, 117 feet to the place of beginning, containing 1/2 acre, more or less, and being Lot no. 1 of the ‘Division of 2.15 acre Tract âBã of Hilltop Addition.ã
It appearing by affidavit filed in this the following.
- That Plaintiff and its counsel have used due diligence to ascertain the whereabouts of Defendants, Brian Edward Miller and Bruce Evan Miller and process has been delivered twice to the Sheriff for them and each time has been returned as not found.
- That as Brian Edward Miller may be deceased, his unknown heirs and/or devisees have been named as Defendants herein.
- That the only address which Plaintiff has for Ruth M. Gorris is in care of the West Virginia Department of Health and Human Resources and attempts to serve her by mail was directed to the Department who responded that it forwarded the summons and complaint to the said Ruth M. Gorris, but that it was not authorized to answer the complaint for her. Thus it appears that the said Ruth M. Gorris is a nonresident of the State for whom no agent, or appointed or statutory agent or attorney in fact is found in this State upon whom service may be had.
ORDERED, that Defendants Brian Edward Miller, his unknown heirs and/or devisees and Bruce Evan Miller and Ruth M. Gorris do appear and serve upon R. Vance Golden, III, Plaintiff’s attorney, whose address is 543 Fifth Street, Parkersburg, WV 26101 an answer or defense to the complaint filed in this action on or before the 16th day of November, 2015, otherwise judgment by default will be taken against them at any time thereafter.
A copy of the complaint can be obtained from the Clerk at her office located at 2 Government Square, Room 133, Parkersburg, WV 26101 in said County and State.
