By virtue of that certain Deed of Trust made by Caroline J. Hepburn and John E. Hepburn, Grantors to William G. Petroplus, Trustee dated the 5th day of October, 2007, and of record in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book 1337, at Page 513; and that certain Appointment of Successor Trustee dated the 13th day of January, 2022, and of record in the Office of the aforesaid Clerk in Deed of Trust Book 1647, at Page 684, the undersigned will sell at public auction and subject to the terms and conditions set forth in this Trustee’s Notice of Sale and in the said Deed of Trust on the 12th day of May, 2022, at 10:00 a.m. at the northwest front door of the Ohio County Courthouse, 1500 Chapline Street, Wheeling, West Virginia, 26003, the following described property situate at 10 Alfred Street, Wheeling, Ohio County, West Virginia, 26003 and being more particularly described as follows:

Two certain lots or parcels of land in the David M. Alexander’s Addition to Greggsville in Wheeling, Ohio County, West Virginia, being Lots Numbered 52 and 53, as described in the plat of said Addition made by Surveyors Hodge and White in April, 1896, of record in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Plat Book No. 1, Page 60.

Said Lots Numbered 52 and 53 have a frontage of 25 feet each on Third Street and extend in a westerly direction of equal width 118 feet to Alley “C”.

Being the same property conveyed to John E. Hepburn and Caroline J. Hepburn, husband and wife, by Deed of Paul D. Bobick and Roxanne R. Bobick, married, dated the 5th day of October, 2007, and of record in the Office of the aforesaid Clerk in Deed Book 780, at Page 165. Also being the same property identified as Tract One in that certain Deed of Dixon Hepburn, Grantor, to Cassie M. Oleksiak and Daniel J. Oleksiak, wife and husband, dated the 3rd day of February, 2020, and of record in the Office of the aforesaid Clerk in Deed Book 975, at Page 689.

TERMS OF SALE: Sale of the property will be made subject to the lien for any and all real estate taxes, whether or not currently due, owing, delinquent, or payable, whether paid or otherwise not currently payable; including especially, but not limited to, the lien of Community Bank, formerly known as Progressive Bank, N.A., dated the 5th day of October, 2007, and of record in the Office of the aforesaid Clerk in Deed of Trust Book 1337, at Page 515 and otherwise referred to above; and further sale of the subject interest in the property is subject to any and all other liens, encumbrances, or adverse claims of interest which may be superior to the lien of the said Deed of Trust being foreclosed upon or the title of Trustee hereunder. The property will be conveyed in an “AS IS”, without warranty or representation, express or implied, as to title, physical condition, environmentally condition, or any other adverse condition which might affect merchantability, marketability, fitness, or use of the property. The property will be conveyed subject to the Internal Revenue Service right of redemption, the Purchaser shall be responsible for the payment of the excise tax on the privilege of transferring real property; the Trustee reserves the right to continue the sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee; the Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property or any duty to remove any personal property and/or belongings remaining at the property after the subject sale. CASH IN HAND or CERTIFIED FUNDS (Certified check) in full in the amount of the successful bid or bids on the day of the sale is required for any bidder to purchase the subject property.
