Notice is hereby given that the undersigned Substitute Trustee, appointed by document dated November 30, 2022, and of record in the Office of the Clerk of the Wetzel County Commission in Deed of Trust Book 449, at page 696, will sell at public auction to the highest bidder on:
February 13, 2023, at 11:00 a.m.,
at the front door of the Wetzel County Courthouse, 200 Main Street, New Martinsville, West Virginia, that certain property conveyed by Timothy C. Wilcox and Christena Wilcox to Ronal W. Rush, Trustee, by Deed of Trust dated September 15, 2015, and recorded in the office of the said Clerk of the County Commission of Wetzel County, West Virginia, in Deed of Trust Book 390, at page 296, and being described as follows:
The following described property situate in the Village of Reader, Green District, Wetzel County, West Virginia, that is to say:
Parcel No. 1: All of Lot Number Thirty-Six (36) as designated on the plat of the village of Reader, as recorded in the office of the Clerk of the County Commission of Wetzel County, West Virginia, and more particularly described as follows: Beginning at a stake in the line of John Lantz, thence South 53 degrees West 140 feet to a stake corner to Lot No. 35, thence in a Northern direction with a line of Lot No. 35, 86 feet to a stake at the County Road, thence with the County Road 140 feet to the place of beginning.
Parcel No. 2: All that certain parcel of land situate in what is known as the John and Samuel Lantz Addition to the said village of Reader, and Beginning at a stake, corner to M. C. Bucher, thence North 60 degrees East 59 feet to a stake in the County Road, thence South 10 degrees West 50 feet to a stake in Laura McAllister’s line, thence North 80 degrees West 50 feet to the beginning, containing 1100 square feet, more or less.
Parcel No. 3: All of Lot Number Thirteen (13) as designated on what is known as the John and Samuel Lantz Addition to the said village of Reader, and adjoining the above Parcel No. 2 and beginning at a stake in McAllister’s line, thence South 31 degrees West 223 feet to a stake on top of point, thence North 38 degrees West 138 feet to a stake in original line, thence North 54 1/2* East 163 feet to a stake, thence South 80* East 65 feet to the beginning.
Parcel No. 4: All that certain lot or parcel of land situate in or near the village of Reader, in Green District, Wetzel County, West Virginia, known as Lot Number Twenty-Four (24) lying on the south side of the Baltimore and Ohio Railroad and fronting fifty (50) feet, more or less, upon the right of way of said Railroad Company and extending about fifty-seven (57) feet in a southerly direction to the line of the County Road, the southern boundary being the center of the said County Road for a distance of about sixty-five (65) feet, more or less, containing approximately 3,164 square feet.
Parcel No. 5: Two (2) certain lots, situate in the Town of Reader, Green District, Wetzel County, West Virginia, known as Lots Number Twenty-Two (22) and Twenty-Three (23), as shown by the plat of said Town, which is of record in the office of the Clerk of the County Commission of Wetzel County, West Virginia, bounded as follows: On the North by the B & O R.R. Company; On the East by the County Road; On the South by the County Road; and On the West by Lot Number 24 of said Town.
Being the same properties conveyed to Timothy C. Wilcox and Christena Wilcox, husband and wife, by Bobby R. Williams and Wilda L. Williams, husband and wife, by Deed dated September 15, 2015, and recorded in Wetzel County Deed Book 445, at page 894.

The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record if any pertaining to said real estate; (2) any and all unpaid taxes assessed against said property; (3) the subject property will be sold in “as is” condition; (4) the Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property; (5) the Substitute Trustee will deliver a Substitute Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Substitute Trustee makes no representations or warranties about the title of the real estate to be conveyed.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Substitute Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
Any sale hereunder in which the property is encumbered by Federal Tax Liens will be subject to the 120-day redemption period pursuant to 26 U.S.C.A. section 7424(d).
