NOTICE OF
TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated June 22, 2018, executed by Borrower(s), Misty D Harriman, to David G. Palmer, the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 2024, at Page 577. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 12003 Emerson Ave, Parkersburg, WV 26104. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated September 19, 2023, of record in the Clerk’s Office in Book 2302, Page 512. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:

27th day of November, 2023 at 11:45 a.m.

All that certain lot or parcel of land situate in the District of Williams, County of Wood, State of West Virginia, and being more particularly described as follows: BEGINNING at an iron rod in the northerly line of a 40.00 foot right of way as described in a Deed of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 942 at page 351, from which the northerly right of way line of WV Route 2 bears S. 56-37 E. 114.20 feet; thence along the westerly end of said 40.00 foot wide right of way S. 07-55 W. 40.00 feet to an iron rod; thence S. 88-03 W. 85.58 feet to an iron rod; thence S. 78-12 W. 72.70 feet to an iron pipe; thence N. 76-30 W. 36.08 feet to an iron pipe; thence N. 09-17 W. 12.50 feet to an iron pipe; thence N. 82-47 W. 104.68 feet to an iron pipe; thence N. 26-14 W. 216.87 feet to an iron pipe in the northerly line of the parent tract; thence with the northerly line of the parent tract two courses and distances: S. 89-09 E. 34.90 feet to an iron pipe and N. 88-41 E. 309.15 feet to an iron pipe said point being a corner common to. Dennis Green and G. McClung; thence with the common line of the Green and McClung S. 17-17 E. 185.36 feet to the common place of beginning, containing 1.598 acres as described on plat of survey by James L. DeBrular, which is of record in the aforesaid Clerk`s Office in Deed Book 959, at page 6. The Grantors herein further grant and convey unto the Grantees, their heirs, successors and assigns, that certain right of ingress and egress from WV Route 2 over and across an existing 40.00 foot wide right of way as more particularly shown on that certain plat of record in the aforesaid Clerk`s Office in Deed Book 959, at page 6. BEING the same real estate conveyed unto Misty D. Harriman, a single person, by a Deed dated June 22, 2018, and to be recorded in the aforesaid Clerk`s Office immediately prior hereto. This conveyance is made subject to all easements, rights of way, restrictions, reservations and protective covenants, including but not limited to all oil, gas and mineral exceptions, reservations and leases, appearing in the chain of title.

Being the same property conveyed to Misty D Harriman by the Deed dated June 22, 2018 and recorded in Deed Book 1280 at Page 172 in the Office of the Clerk of the County Commission of Wood County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamati”€‹on, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
