TRUSTEE S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated October 11, 2013, and duly recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed of Trust Book 516, at Page 571, Robert W. Larkin and June L. Larkin did convey unto Barry Dobson and Chad E. Prather, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Randolph County Courthouse, in , West Virginia, on December 19, 2023, at 10:10 AM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the District, Randolph County, West Virginia, and more particularly described as follows: Situated in Roaring Creek District, Randolph County, West Virginia, the original tract being more particularly bounded and described as follows: Beginning at a dogwood, Eli H. Rowan’s Corner, standing at the edge of Staunton Pike, and running thence with H. Paugh’s line, S 44 1/2 E to the lands of Mary E. Hart; thence with her line same course, in all 97 poles to a stake in same line; thence with division line through the survey, S 48 W 128 poles to a stake in the outside line; thence with same, N 44 1/2 W 139 poles to a stake at the south edge of pike; thence with same N 69 E poles, N 74 1/2 E 20 Poles, N 35 1/2 E 17 poles, N 67 1/2 E 18 poles, S 50 E 12 poles to a small bush in Short Bend, thence N 22 1/2 E 14 poles, N 75 1/2 E 35 poles crossing Laurel Run to a stake; thence N 65 E 15 poles to the beginning, containing 100 acres more or less; however, there is reserved from this conveyance, a tract or parcel of land containing 30.00 acres, more or less, described as follows: A tract or parcel of land situate on the WV secondary Rt. 37/8 or (the Old Staunton-Parkersburg Turnpike), on the south side thereof, about 1 mile southeast of Mabie, WV, on the waters of Laurel Branch, Roaring Creek District, Randolph County, West Virginia, To-wit: Beginning at an axle, found, in the southern boundary of said WV secondary Rt. 37/8 30 feet from the center thereof, a corner to Harry L. August (now Larkin) land, set a RR spike in the southwest base of a 22 white oak, 2.0 feet from the center of said tree, from which 7″ white oak bears S 48 00 W 11.4 feet; thence through the parent August ( now Larkin) tract, S 40 21 E 2089.59 feet to a point, a corner of said August (now Larkin) lands on a corner line of Clifton E. & Carol Hyre (DB 265/340), set a 3/4″ x36″ rebar with plastic cap and stone pile, from which a set stone, found, bears N 54 59 W 605.40 feet to a stone pile, found, a corner in line of said Hyre, a corner to John G. Davisson, Et Al.(DB 173/239) and a corner to Jimmie & Cindy Chewning (DB 314/664), set with a 3/4″ x 36″ rebar with plastic cap in the center of said stone pile, from which a set stone, found, bears S 54 29 W 249.4 feet, a 15″ chestnut oak with old hacks bears S 18 55 W 11.7 feet, a 5″ sourwood gum, bears N 56 00 W 4.0 feet; thence with said Chewning for part of a line, N 40 20 W at 1420.97 feet crossing a 1/2″ iron pipe and stone pile, found, a corner to said Chewning and Lambert, in all 2294.20 feet to the beginning, containing 30.00 acres, more or less, as surveyed March 1991 by Leon G. Mallow PLS #567 and shown by plat; and the 30.00 acres, more or less, reserved from this conveyance and hereinabove described is the same real estate conveyed to Robert W. Larkin, Jr., and Edith L. Larkin, husband and wife, by Roberta August, Widow, by Deed dated 29th August, 1991 and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 414, Page 130. It is understood that the real estate conveyed by this Deed contains 70 acres, more or less, and is assessed upon the 1993 land books for Roaring Creek District as Tax Map 126 part of Parcel 55 and being 70 acres, more or less, of the 100 acres described and conveyed to Robert W. Larkin, Jr., and Edith L. Larkin, Husband and Wife, and Anita L. Larkin, single, by Roberta August, Widow by Deed dated 14th August 1992 and of record in the Office of the Clerk of the County Commission of Randolph, West Virginia in Deed Book 420, Page 754; it is further understood that the description of the 100 acres (Deed Book 420, Page 754) encompasses the 30.00 acres herein reserved and described, thus leaving 70 acres, more or less, being here now conveyed. Subject to all easements, covenants, conditions, reservations, leases and restrictions of record, all legal highways, all rights of way, all zoning, building and other laws, ordinances and regulations, all rights of tenants in possession, and all real estate taxes and assessments not yet due and payable. Larkin (Deed Book 414, at Page 130), thence with a line of the parent Larkin 30 acre tract (Now 6.73 acre tract) -Deed Book 414, at Page 130 S. 40 Deg. 20? E. 487.85 feet to a 3/4 inch rebar with a 2-3/4 inch diameter plastic cap and stone pile, found, a corner to said Robert W. and Edith L. Larkin and a corner to Steven R. and Debra Larkin (Deed Book 446, at Page 760), from which an 18 inch Red Maple Bears N. 83 Deg. 30? W. 4.6 feet, thence with said Steven R. Larkin S. 40 Deg. 20? E. 385.38 feet to a 1/2 inch iron pipe and stone pile, found, a corner in line of said Steven R. and Debra Larkin, a corner to said Harry L. Estate in all 113.83 feet to a point in the center of a Cul-De-Sac, having a radius of 50 feet, corner to Lot No. 4 of Rich Mt. Estates, from which a water meter bears S 55 56 E 85.30 feet and a water valve bears S 58 02 E 78.54 feet thence, S 47 24? E, at 39.96 feet crossing a set 3/4 inch by 30 inch rebar in all 289.67 feet to a set 3/4 inch by 42 inch rebar with a 2-3/4 inch diameter orange plastic cap set at southeast base of blazed sourwood, corner to said Lot No. 4 of Rich Mt. Estates and a corner in line of Inter-State Hardwoods (Deed Book 459 at page 218), thence with said Inter-State Hardwoods. S 54 59? W, 268.40 feet to a set 3/4 by 42 inch rebar with a 2-3/4 inch diameter orange plastic cap, on top of a road bank, a corner in line of said Inter-State Co. Inc. and a corner to Robert W. and June L. Larkin reserved land (Deed Book 427 at Page 57), thence with said reserved land for two lines. N 34 22??W, 389.60 feet to a set 3/4 by 42 inch rebar with a 2-3/4 inch diameter orange plastic cap on top of said road bank, thence, N 53 05? E, at 166.53 feet crossing a set 3/4 by 42 inch rebar with a 2-3/4 inch diameter orange plastic cap in all 187.19 feet to the beginning, containing a gross area of 2.02 acres, as surveyed in March-May of 2007 and May 2008 by Leon G. Mallow, Professional Surveyor No. 567, Route 1, Box 117, Montrose, WV and as shown on a plat attached hereto and made part of this description. AND BEING part of the same real estate as conveyed unto Robert W. Larkin and June L. Larkin by Robert W. Larkin Jr and Edith L. Larkin by deed dated July 7, 1993 and of record in Deed Book 427, at Page 57. The said Robert W. Larkin died September 13, 2017. Pursuant to the survivorship language contained in said deed, the property vested in the survivor, June L. Larkin in fee simple absolute. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 7279 Rich Mountain Road, Mabie, WV 26278. AND BEING a part of the same real estate which was conveyed to Robert W. Larkin and June L. Larkin, by Deed dated July 7, 1993 , from Robert W. Larkin, Jr, Edith L. Larkin and Anita L. Larkin, and recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 427, at Page 57. The above-described property will be sold subject to any covenants, restrictions, easements, leases, and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in AS IS condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
