TRUSTEE’S SALE OF REAL ESTATE
By virtue of the authority vested in her by that Deed of Trust described below and default having been made under the aforementioned Deed of Trust, the Trustee, Holly S. Planinsic, having been instructed by the Beneficiary to foreclose thereunder, will offer for sale at public auction the real estate hereinafter described, which sale will be conducted at the front steps of the Ohio County Courthouse, located at 1500 Chapline St, at Wheeling, Ohio County, West Virginia, on Friday, December 22, 2023 at 9:00 a.m.
The Beneficiary has elected to appoint Holly S. Planinsic as Trustee under that certain Deed of Trust, dated June 22, 2023, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book 1674, at page 786, wherein Roxby Development, LLC, The Monastery, LLC, Jeffery J. Morris, and Jeffrey S. Morris, did convey unto Holly S. Planinsic, Trustee, certain real and personal property described in said Deed of Trust for the benefit of Jolu Properties, LLC and the Selby Family Trust.
The Trustee shall sell the following described parcels of real estate, with improvements, easements, appurtenances and fixtures thereunto belonging, situate in the City of Wheeling, Ohio County, West Virginia, and being more particularly bounded and described as follows:
PARCEL 1 – The following tract of land situate on the easterly side of Carmel Place, and comprising all of Lots 6 and 7 as shown on the “Map showing final Revision of Goshorn’s Addition to Pleasant Valley” said plat being recorded in the office of the Clerk of the County Court of Ohio County, West Virginia in Plat Book 1, at page 84, City of Wheeling, Triadelphia District, Ohio County, West Virginia and being more particularly bounded and described as follows:
Beginning at a concrete monument in the easterly line of Carmel Place (formerly called Goshorn Street) at its intersection with the northerly line of Lot 5 as shown on said map; thence from said beginning monument and with said easterly line of Carmel Place, the following two (2) bearings and distances: N. 28 degrees 45′ W. 100 and 2/100 feet to an iron pin at the most westerly corner of Lot 7 as shown on said map; thence leaving said Lot 7 and continuing with said easterly line of Carmel Place N. 18 degrees 45′ W. 126 and 41/100 feet to a point; thence leaving said Carmel Place and with other lands now owned by the party of the first part, hereto, N. 66 degrees 06′ E. 233 and 83/100 feet to a point in the southerly line of the 31 and 968/1000 acre tract of land now or formerly owned by the Sisters of Our Lady of Charity; thence with same S. 31 degrees 46′ E. (at 92 and 3/10 feet passing the intersection of the northerly line of said Lot 7 with the westerly line of a 12 feet wide private road as shown on said map) 192 and 3/10 feet to a point in the aforesaid northerly line of Lot 5; thence leaving said 12 feet wide private road and with said northerly line S. 58 degrees 30′ W. 265 and 37/100 feet to the place of beginning containing by calculations made by Stegman & Schellhase, Inc., Civil Engineers and Surveyors, One and Two Hundred Sixteen One Thousandths (1 and 216/1000) acres, more or less.
The said 1 and 216/1000 acre tract of land being subject to any and all conditions, exceptions, reservations, stipulations, rights of way, etc. as may be contained in former deeds of conveyance.

PARCEL 2 – The following tract of land situate on the easterly side of Carmel Place, City of Wheeling, Triadelphia District, Ohio County, West Virginia and being more particularly bounded and described as follows:
Beginning at a point in the easterly line of Carmel Place at the most southerly corner of the herein described tract, said beginning point being located N. 18 degrees 45′ W. 126 and 41/100 feet from the most westerly corner of Lot 7 as shown on the “Map showing final Revision of Goshorn’s Addition to Pleasant Valley” said map being recorded in the office of the Clerk of the County Court of Ohio County, West Virginia in Plat Book No. 1, at page 84; thence from said beginning point and with said easterly line of Carmel Place N. 18 degrees 45′ W. 295 feet to an iron pin at a corner to lands now or formerly owned by J.F. Shirk; thence leaving said Carmel Place and with the southerly line of said J.F. Shirk, N. 69 degrees 20′ E. 168 and 34/100 feet to an iron pin in a southerly line of lands now or formerly owned by Echo Coal Company; thence with same S. 31 degrees 46′ E. [at 73 and 81/100 feet passing the most westerly corner of the 31 and 968/1000 acre tract now or formerly owned by the Sisters of Our Lady of Charity] 287 feet to a point; thence leaving the said 31 and 968/1000 acre tract and with other lands now owned by the party of the first part hereto, S. 66 degrees 06′ W. 233 and 83/100 feet to the place of beginning, containing by calculations made by Stegman & Schellhase, Inc., Civil Engineers and Surveyors, One and Three Hundred Thirty-Two One Thousandths [1 and 332/1000] acres, more or less.
The said 1 and 332/1000 acre tract being subject to any and all conditions, exceptions, reservations, stipulations, rights of way, etc. as may be contained in former deeds of conveyance.

Being the same property conveyed to The Monastery, LLC from Gupta Properties, LLC by Deed dated January 31, 2020 and recorded in Deed Book 977, at page 682 in the Office of the Clerk of County Commission of Ohio County, West Virginia.
At the time of the execution of the Deed of Trust, this property was reported to have an address of 102 Carmel Road, Wheeling, West Virginia 26003.
The above-referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way, reservations, exceptions, leases which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, assessments, service fees, and utility charges and further to any matters which would be disclosed by an inspection or accurate survey of the real estate. The purchaser at the sale shall be responsible for paying any outstanding real estate and personal property taxes, title transfer fees, sales tax, recording costs and also the excise tax on the privilege of transferring real property.
The subject property will be sold in “AS IS” condition. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
The successful bidder shall pay twenty percent (20%) of the purchase price in cash or certified funds at the time of the auction/sale and the balance shall be due within thirty (30) days.
PERSONAL TAX LIEN: In the event there are federal tax liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for the redemption under local law, whichever is longer.
The Trustee may continue or postpone the sale by public announcement at the time and place designated or by posting a notice of the same and without further notice, and act by agent in the execution of the sale. The Trustee shall have the right to reject any bid or bids which the Trustee, in her sole discretion, deems inadequate. The Beneficiary reserves the right to purchase the property at such sale.
