DEED OF TRUST
Notice is hereby given that, under authority of a certain deed of trust hereinafter described, the undersigned Trustee will, at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on
September 16, 2024 at 1:00 p.m.
offer for sale certain property described in that certain deed of trust executed by Douglas Wayne
Morrow and Brandy Morrow, husband and wife, to the undersigned as Trustee, which deed of trust is described as bearing date the 1st day of December 2021; and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 612 at page 417, and given to secure Equity Trust Company (Custodian FBO #200422215 IRA) , the payment of a note therein described, and which said property is described as follows:
All those certain tracts of real estate, situate in Roaring Creek District, Randolph County, West Virginia, and being more particularly described as follows. The surface
only of Lot No. 3 of Block No. 16 of the Townsite of Norton, which is bounded on the north for 150 feet by Lot No. 2 of said Block, on the east for 100 feet by Coalton Avenue, on the south for 150 feet by Lot No. 4 of said Block, on the west for 100 feet by a 20-foot alley, said Lot No. 3 being rectangular in shape. And Being the same real estate conveyed to Equity Trust Company Custodian FBO #200422215 IRA from Losha A. Zirkle by Deed dated June 25, 2021, and of record in the Office of the Clerk of the Randolph County Commission, in Deed Book 619 at page 39. This conveyance is subject to a right-of-way to extend the water pipeline serving said lot through the same to service adjoining lands and the right to maintain, repair, replace or remove said extensions, provided such extension shall not damage any building on said lot. The provisions of this paragraph shall be construed as a covenant running with, and for the benefit of such adjoining lands, the owner thereof, any corporation or person who may provide or sell water through said pipeline.
The above-described property will be sold by Special Warranty Deed subject to all reservations, restrictions, exceptions and conditions of record or visible on the ground and
subject to all unpaid levies and assessments including real estate taxes.
TERMS OF SALE:
1. The property is in “AS-IS” physical condition by Deed containing Special Warranty, subject to the Internal Revenue Service right of redemption, all property taxes, prior
Deeds, liens, reservations, encumbrances, restrictions rights-of-way, easements, covenants,
conveyances, and conditions of record in said Clerk’s Office.
2. Purchaser shall be responsible for the payment of transfer taxes as imposed by W.Va. Code 11-22-1.
3. The beneficiary and/or servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4. The trustee shall be under no duty to cause any tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after foreclosure will be deemed to constitute abandoned property and will be disposed of accordingly.
5. Total purchase price is payable to the Trustee within thirty (30) days of the date of sale with 10% of the total purchase, non-refundable, via cash or cashier’s check payable to
Trustee on the date of sale. The undersigned Trustee reserves the right to reject any and all bids received, and to continue said sale from time to time, upon announcement thereof given verbally, on day of sale and any continuance thereof.
