NOTICE TO POSSIBLE CLAIMANTS OF RESIDENCE OF ANETA SUMMERFIELD LOCATED AT 88 MILL BROOK ST., ELKINS, WV 26241, Parcel ID 42-10-00024-0078-0000, Leadsville District, and on record with the Randolph County Clerk in Will Book 51, Page 358, ONE (1)12 GAUGE, MODEL SB, BRAZILIAN SINGLE SHOT, serial no. 323520, SIX HUNDRED TEN DOLLARS, ($610.00) In United States Currency BY SERGEANT J.M. TALLMAN OF THE MOUNTAIN REGION DRUG AND VIOLENT CRIMES TASK FORCE ON July 29, 2024.
On or about July 29, 2024, Sergeant J.M. Tallman of the West Virginia State Police and assigned to the Mountain Region Drug and Violent Crimes Task Force conducted an investigation regarding Timothy Summerfield committing the offense of Possession of a Controlled Substance with Intent to Deliver, pursuant to W. Va. Code Section 60A-4-404(a)(i) and, pursuant to that investigation, seized the residence/real property of Aneta Summerfield located at 88 Mill Brook St., Elkins, WV 26241, Parcel ID 42-10-00024-0078-0000, Leadsville District, One (1) 12-gauge, model SB, Brazilian single shot, serial no. 323520, and $610.00 in United States Currency. Said property was found in the actual or constructive possession of Timothy Summerfield, Aneta Summerfield, and/or Kristin Wilburn.
The Petitioners believe that the said residence/real property of Aneta Summerfield located at 88 Mill Brook St., Elkins, WV 26241, Parcel ID 42-10-00024-0078-0000, Leadsville District, One (1) 12-gauge, model SB, Brazilian single shot, serial no. 323520 , and $610.00 in United States Currency are subject to seizure and forfeiture, pursuant to the West Virginia Contraband Forfeiture Act (W. Va. Code Sections 60A-7-703 and 704), and that said residence/real property of Aneta Summerfield located at 88 Mill Brook St., Elkins, WV 26241, Parcel ID 42-10-00024-0078-0000, Leadsville District, One (1) 12-gauge, model SB, Brazilian single shot, serial no. 323520, and $610.00 in United States Currency were used to facilitate the sale, receipt, possession, manufacturing, possession with intent to deliver, and/or delivery of controlled substances in violation of Chapter 60A of the Code of West Virginia.
Petitioners seek an Order from the Circuit Court of Randolph County, West Virginia that the said residence/real property of Aneta Summerfield located at 88 Mill Brook St., Elkins, WV 26241, Parcel ID 42-10-00024-0078-0000, Leadsville District, One (1) 12-gauge, model SB, Brazilian single shot, serial no. 323520, and $610.00 in United States Currency be forfeited to the State of West Virginia and ownership of said property be vested in the State of West Virginia; that, thereafter, it be disposed of according to law.
Any claimant to the above referenced property being residence/real property of Aneta Summerfield located at 88 Mill Brook St., Elkins, WV 26241, Parcel ID 42-10-00024-0078-0000, Leadsville District, One (1) 12-gauge, model SB, Brazilian single shot, serial no. 323520, and $610.00 in United States Currency has a right to file a claim on or before November 21, 2024. Any claim must clearly state the identity of the claimant and an address where legal process can be served upon them and must be filed with the Circuit Clerk of Randolph County, West Virginia.
