The object of the above entitled action is the release of $10,000.00 held is escrow from a real estate transaction.
And it appearing by an affidavit filed in this action that the Defendant was not served, either personally or by way of service upon an appropriate family member, after service was twice attempted by the Sheriff of the county in which the Defendant resides or is located.
It is ordered that Jamie Arbizu do serve upon Will Fanning at 2801 Julia Road, Renick, West Virginia 24966 and Benjamin Shelpler, magistrate, whose address is 11 Randolph Avenue, Elkins, West Virginia 26241, an answer or other defense to the complaint filed in this action on or before December 13, 2024, otherwise judgement by default will be taken against Jamie Arbizu at any time thereafter. A copy of said complaint can be obtained from the undersigned Clerk at her office.
