TRUSTEE’S SALE OF

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated October 5, 2020, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed of Trust Book 2138, at Page 615, Megan R. Burley did convey unto David G. Palmer, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse, in Parkersburg, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Parkersburg District, Wood County, West Virginia, and more particularly described as follows:

FIRST TRACT: BEGINNING on the westerly side of Smithfield Street one hundred seven and 69/100 (107.69) feet from the northwesterly corner of Columbia Avenue and Smithfield Street, at the common corner of Lots Nos. 10 and 11 Columbia Terrace Addition, and running thence in a northwesterly direction with the common line of Lots Nos. 10 and 11 one hundred six (106) feet to a twenty foot alley; thence in a northeasterly direction with the line of said alley, twenty-five (25) feet to a point; thence in a southeasterly direction, parallel with the common line of said Lots Nos. 10 and 11, one hundred six (106) feet to the line of Smithfield Street; thence in a southwesterly direction with the line of Smithfield Street, twenty-five (25) feet to the place of beginning, being the southerly half of Lot No. 11 of said Columbia Terrace Addition, as shown on a plat of said Addition of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book 4, at page 120.

SECOND TRACT: BEGINNING on the westerly side of Smithfield Street, fifty-seven and 69/100 (57.69) feet from the northwesterly corner of Lots Nos. 9 and 10 of Columbia Terrace and running thence in a northwesterly direction with the common line of Lots Nos. 9 and 10 one hundred six (106) feet to a twenty foot alley; thence in a northeasterly direction with the line of said alley, fifty (50) feet to the common corner of Lots Nos. 10 and 11 of said Addition; thence in a southeasterly direction, with the common line of said Lots Nos. 10 and 11, one hundred six (106) feet to the line of Smithfield Street; thence in a southwesterly direction, with the line of Smithfield Street, fifty (50) feet to the place of beginning, being all of Lot No. 10 of said Columbia Terrace Addition, as shown on a plat of said Addition of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book 4, at page 120.

There is EXCEPTED from the above described real estate the following tract, which was conveyed by deed dated July 20, 1054, and of record in the aforesaid Clerk’s Office in Deed Book 379, at page 129.

BEGINNING on the westerly side of Smithfield Street fifty-seven and 69/100 (57.69) feet from the northwesterly corner of Columbia Avenue and Smithfield Street, as the common corner of Lots Nos. 9 and 10 of Columbia Terrace Addition, and running thence in a northwesterly direction with the line of said alley, twelve and 50/100 (12.50) feet to a point; thence in a southeasterly direction, parallel with the common line of said Lots Nos. 9 and 10, one hundred six (106) feet in the line of Smithfield Street; thence in a southwesterly direction twelve and 50/100 (12.50) feet to the place of beginning, being a part of Lot No. 10 of Columbia Terrace Addition, as shown on a plat of said Addition of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book 4, at page 120.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1017 Smithfield Street, Parkersburg, WV 26101.

AND BEING the same real estate which was conveyed to Megan R. Burley, by Deed dated October 5, 2020, from Clayton Yoxtheimer, by Toby DuCellier, his attorney-in-fact and Nazmije Yoxtheimer, erroneously referred to as Nazmije Yoxtheier in prior deed, and recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 1313, at Page 203.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
