NOTICE OF TRUSTEE’S SALE
Pursuant to the authority vested in the undersigned J. Patrick Jones, Substitute Trustee by Notice of Substitution of Trustee which notice is of record in the Office of the Clerk of the County of Commission of Wood County, West Virginia, and by Deed of Trust dated May 25, 2022, executed by Seaside Ventures, LLC to Ryan J. Kent, Trustee, which deed of trust is of record in the Office of the Clerk of Wood County, West Virginia, in Trust Deed Book 2244 at Page 674, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee will sell the real estate described in the Deed of Trust, at a public auction on March 7, 2025 at 3 p.m. to the highest bidder at the front door of the Courthouse of said County of Wood, in Parkersburg, West Virginia, which real estate is more completely described as follows:
FIRST TRACT: BEGINNING at a point in the easterly side of Market Street in the partition line between the real estate known as the “Bond property”, which point is about 97 feet south of Fifth Street (assuming said Fifth Street runs east and west); thence with the easterly line of Market Street in a southerly direction and toward Fourth Street 21 feet to a point in the partition line between the real estate hereby granted and the real estate commonly known as the “Rafferty property”; thence with said partition line S. 38* 09 E. 170.4 feet to a point in the westerly line of Phillips Court Alley; thence with the westerly line of said alley, running in a northerly direction toward Fifth Street, 21 feet to a point in said partition line between the real estate hereby granted and said Bond property; thence with the partition line last aforesaid, 170.4 feet, more or less, to the place of beginning.
SECOND TRACT: BEGINNING at a point in the easterly side of Market Street (assuming said Market Street to run approximately north and south) at a point 72 feet from the corner of Fifth and Market Streets; thence S. 51* 52′ W. running with said Market Street 25 feet to a point in the line of the real estate sometimes known and herein called “the Whitstead property”, granted unto Anthony P. Jalwan by Josephine Sexton and others, by their deed dated September 24, 1958, recorded in the office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 425, 425 at page 519; thence with the partition line between said Whitstead property and the property hereby granted, S. 38* 09′ E. 90 feet to a point in the real estate hereinafter described as “THIRD TRACT”; thence towards Fifth Street and with the line of said Third Tract 25 feet, more or less, to a point; thence N. 38* 09″ W. 90 feet, more or less, to the place of beginning.
THIRD TRACT: BEGINNING at a point on the west side of Phillips Court Alley (assuming said alley to run approximately north and south) at a corner of Whitstead property; thence with said line of said alley, running in a northerly direction towards Fifth Street about 11.67 feet to the corner of a lot now or formerly known as the I.O.O.F. Templet lot; thence at right angles and along the line of said lot and also with the line of a lot formerly owned by Mrs. Dora Buehler and parallel with Fifth Street, 80 feet to a line of said “SECOND TRACT”; thence at right angles and with the line of said Second Tract about 11.67 feet to the Whitstead property; thence at right angles and with the line of said Whitstead property parallel with Fifth Street, about 80.00 feet to a point in the west side of Phillips Court Alley, the place of beginning.
FOURTH TRACT: BEGINNING at a point in the division line between lots Numbers 91 and 92, as shown on a plat of the Town of Parkersburg, recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in plat Book No. 2, at page 42, said point being located Ninety (90) feet south of the southerly property line of Market Street; thence North 51* 52′ East, twenty-eight and six-tenths (28.6) feet; thence South 38* 09′ East, twenty (20) feet; thence South 51* 52′ West; Nineteen and eighty-five hundredths (19.85) feet; thence South 38* 09′ East, seven and five tenths (7.5) feet; thence South 2* 44′ East, fifteen and thirty-four hundredths (15.34) feet to the said division line between lots Numbers 91 and 92; thence with said line North 38* 09′ East, forty (40) feet to a point; thence at right angles eight and seventy-five hundredths (8.75) feet to the place of beginning.
FIFTH TRACT: BEGINNING on the southwest side of Fifth Street, seventy (70) feet eastwardly from the corner of said Fifth and Market Streets; thence with Fifth Street eastwardly twenty (20) feet; thence with the line of Morlang property at right angles, twenty (20) feet; thence parallel with the second line forty-nine (49) feet to Fifth Street, the beginning.
SIXTH TRACT; BEGINNING on Fifth Street at the easterly corner of the lot above described; thence in an easterly direction twenty (20) feet to a corner of the Bartlett property; thence with the line of the Bartlett property fifty-six (56) feet, more or less, to the corner of the Bartlett brick building, as was constructed upon said lot; thence at right angles toward Market Street twenty (20) feet to the line of the Beuhler property; thence with the line of the Buehler property and the lot above conveyed, fifty-six (56) feet, more or less, to the beginning.
SEVENTH TRACT; BEGINNING on the southeasterly side of Market Street, 49 feet from the corner of Fifth Street, and running thence with Market Street toward Fourth Street, 23 feet to the Jalwan line; thence at right angles with said Market Street, 90 feet; thence at right angles and toward Fifth Street, 23 feet; thence at right angles toward Market Street, 90 feet to the place of beginning.
EIGHTH TRACT: BEGINNING at the southeasterly corner of the intersection of Market and Fifth Streets, being the northwesterly corner of Lot 92, as shown on the plat of the Town of Parkersburg, recorded in the office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book 2, at page 42; and thence with the line of Fifth Street, in an easterly direction toward Avery Street, 70 feet to a point; thence at right angles and in a southerly direction toward Fourth Street, 49 feet to a point; thence at right angles and toward Market Street, 70 feet to a point in the easterly line of Market Street; thence with the easterly line of Market Street, in a northerly direction, 49 feet to the place of beginning.
Together with all personal property described and set forth in that certain financing statement recorded in said clerk’s office as Lien Book 2330 at page 170..
TERMS OF SALE
1. Cash in hand paid on the day of sale.
2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, rights of way and easements of any nature whatsoever.
3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code § 11-22-2.
4. The subject property will be sold in “AS IS” condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed.
5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
6. The Substitute Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above.
7. The beneficiary of the Deed of Trust and holder of the note thereby-secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid.
8. Such other terms as may be announced at the time of Sale.
