NOTICE OF SUBSTITUTE TRUSTEE’S SALE

Notice is hereby given that the undersigned, Harry A. Smith, III, as Substitute Trustee, will offer for sale at public auction, to the highest responsible bidder, certain real estate, described below, situate in Beverly District, Randolph County, West Virginia. Said real estate will be offered for sale at the front door of the Randolph County Courthouse, Elkins, West Virginia on the 18th day of April, 2025, at 11:00 a.m. The described real estate was conveyed by the following deed of trust securing Mountain Valley Bank, N.A.: a deed of trust executed by Christina L. Elbon, dated August 27, 2003, of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 366 at page 758. The real estate herein offered for sale is, specifically, that certain tract of real estate situate in Beverly District, Randolph County, West Virginia, on waters of Files Creek, about 1 mile southeast of Beverly and more particularly bounded and described as follows:
“Beginning at a point on the northwest side of WV Secondary Route 30/1 in line of Varner and Lambert and from which a 1-1/2 inch pipe found in a fence bears S 48-20 W 1227.7 feet, a corner of Varner and Judy, and a ¾ x 40 inch rebar set as reference bears N 36-37 W 1.7 feet; thence three courses and distances through lands of Varner and with a fence N 36-27 W 164.6 feet to a point, set a ¾ x 40 inch rebar; thence N 50-04 E 135.6 feet to a point, set a ¾ x 40 inch rebar; thence S 38-34 E, at 158.3 feet pass over a ¾ x 40 inch rebar set a reference, in all 160.0 feet to a point in line of Lambert and in the edge of said road; thence with edge of said road and with Lambert S 48-20 W 141.8 feet to the beginning, containing 0.516 acres, more or less and as surveyed in October, 1993, by Leon W. Brown Professional Surveyor, Beverly, WV 26253 . . . .”
Said real estate is assessed in the name of Christina L. Elbon, in Beverly District,
Randolph County, described by the Randolph County Assessor as “0.516 Ac Leonard Land” (Map 131, Parcel 41.1).
Said sale will be “as is” and will be without covenant or warranty and will be subject to all unpaid property taxes and to all outconveyances, reservations, restrictions, exceptions, conditions, covenants, easements, rights-of-way, leases, or other servitudes, if any, made, retained or created in prior deeds of record in the chain of title to the property herein described. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 2 of Chapter 11 of the West Virginia Code.
The undersigned reserves the right to reject any and all bids and to continue the sale of the real estate from time to time by announcement made at the time of the sale or any continuance thereof. The undersigned shall be under no duty to cause any existing tenant or person occupying the property to vacate the property. Any personal property remaining at the property after the foreclosure sale will be deemed to constitute abandoned property, to be disposed of by the purchaser: before such personal property may be deemed abandoned, however, the purchaser must comply with the provisions of §38-1-17, West Virginia Code, and provide proper and legal notice to the previous owners that such personal property remaining on the real property will be deemed abandoned if not removed before the conclusion of the notice period set forth in said Section 38-1-17.
The undersigned was appointed as Substitute Trustee by Appointment of Substitute Trustee dated March 21, 2025, of record in the aforesaid Clerk’s Office in Trust Deed Book 644 at page 619.
