NOTICE OF SUBSTITUTE TRUSTEE’S SALE

Notice is hereby given that the undersigned, Harry A. Smith, III, as Substitute Trustee, will offer for sale at public auction, to the highest responsible bidder, certain real estate, described below, situate in Mingo District, Randolph County, West Virginia. Said real estate will be offered for sale at the front door of the Randolph County Courthouse, Elkins, West Virginia on the 30th day of June, 2025, at 11:00 a.m.
The described real estate was conveyed by the following deed of trust securing Mountain Valley Bank, N.A.: a deed of trust executed by Ava Louise Shrout, dated November 20, 2002, of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 351 at page 410.
The real estate herein offered for sale is, specifically, that certain tract of real estate situate in Mingo District, Randolph County, West Virginia, approximately one (1) mile south of West Virginia Route 15, on the Valley Fork Road and being more particularly bounded and described as follows:
“BEGINNING at an iron pin at edge of the right-of-way of Secondary Route 49, commonly known as the Valley Fork Road, thence crossing said Valley Fork Road, N 52* 48′ W 379.0′ to an iron pin on the southwest side of Valley Fork Road; thence N 35* 12′ E. 59.0′ to an iron pin; thence N 27* 15′ E 132.0′ to an iron pin; thence S 72* 00′ E 49.5′ to an iron pin; thence S 63* 59′ E 181.0′ to an iron pin; thence S 38* 26′ E 63.5′ to an iron pin; thence S 21* 50′ W 177.5′ to an iron pin; thence S 38* 37′ E 96.5′ to the place of beginning, containing 1.21 acres, more or less, as surveyed by Jerry L. Shreve, and shown upon plat of said survey found of record in the aforesaid Clerk’s Office in Trust Deed Book 111 at page 450.”
And being the same real estate conveyed to James J. Shrout and Ava Louise Shrout by Ray M. Conrad and Verlie S. Conrad, by deed dated September 22, 1967, of record in the aforesaid Clerk’s Office in Deed Book 253 at page 37. James J. Shrout predeceased Ava Louise Shrout, and, pursuant to the survivorship clause in the aforesaid deed, title vested solely in Ava Louise Shrout. Ava Louise Shrout is now deceased; by her will, of record in the aforesaid Clerk’s Office in Will Book 69 at page 696, she devised said real estate to Hunter M. Howell.
Said sale will be “as is” and will be without covenant or warranty and will be subject to all unpaid property taxes and to all outconveyances, reservations, restrictions, exceptions, conditions, covenants, easements, rights-of-way, leases, or other servitudes, if any, made, retained or created in prior deeds of record in the chain of title to the property herein described. The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 2 of Chapter 11 of the West Virginia Code.
The undersigned reserves the right to reject any and all bids and to continue the sale of the real estate from time to time by announcement made at the time of the sale or any continuance thereof.
The undersigned shall be under no duty to cause any existing tenant or person occupying the property to vacate the property. Any personal property remaining at the property after the foreclosure sale will be deemed to constitute abandoned property, to be disposed of by the purchaser; before such personal property may be deemed abandoned, however, the purchaser must comply with the provisions of §38-1-17, West Virginia Code, and provide proper and legal notice to the previous owners that such personal property remaining on the real property will be deemed abandoned if not removed before the conclusion of the notice period set forth in said Section 38-1-17.
The undersigned was appointed as Substitute Trustee by Appointment of Substitute Trustee dated April 25, 2025, of record in the aforesaid Clerk’s Office, in Trust Deed Book 647 at page 312.

TERMS OF SALE: Cash in hand on date of sale.
