NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated May 18, 2011, executed by Borrower(s), Kurt J Palmer and Rebecca J Palmer, to David G. Palmer, the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1651, at Page 595. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 233 Deerwalk Hwy, Waverly, WV 26184. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated April 8, 2025, of record in the Clerk’s Office in Book 2365, Page 713. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:

27th day of June, 2025 at 11:00 a.m.

Situate in the District of Union, County of Wood, and the State of West Virginia, more particularly bounded and described as follows, to wit: Beginning at the Northwest corner of Lot No. 4 of said Addition in the Easterly line of West Virginia Route 31, also known as The Williamstown Pike; thence along the common line of Lots Nos. 4 and 5 of said Addition in an Easterly direction, 290 feet to a point; thence at right angles in a Southerly direction, 157.6 feet, more or less, to a point in the Southerly line of said Lot No. 4, in the common line of Lots Nos. 3 and 4 of said Addition; thence in a Westerly direction with the common lines of Lots Nos. 3 and 4, in the Westerly direction with the common lines of Lots Nos. 3 and 4, 290 feet to the Easterly edge of West Virginia Route 31; thence in a Northerly direction along the edge of said West Virginia Route 31; 158.1 feet to the place of beginning. There is however, EXCEPTED and RESERVED by the said parties of the first parties, their heirs and assigns, a twenty-five (25) foot in width trip running parallel along and adjoining the said described property in the Southerly line to the remainder part of said Lot No. 4 a distance of 290 feet for roadway and utility lines purposes to the remainder portion of said Lot No. 4. BEING the Easterly portion of Lot No. 4 of Port View Farms Addition No. 3, as recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book No. 7, at page 80, which was conveyed to Quention R. Massey herein by Deed dated September 3, 2002, and recorded in said Clerk’s Office in Deed Book No. 1044, at Page 610. BEING the same real estate conveyed unto Kurt J. Palmer and Rebecca J. Palmer, husband and wife, by a Deed dated April 26, 2011, and to be recorded in the aforesaid Clerk’s Office immediately prior hereto. This conveyance is made subject to all easements, rights of way, restrictions, reservations and protective covenants, including but not limited to all oil, gas and mineral exceptions, reservations and leases, appearing in the chain of title.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
