NOTICE IS HEREBY GIVEN that, default having been made in the payment of the indebtedness secured by the deed of trust hereinafter described and the undersigned having been required so to do by Union Bank, Inc., the owner and holder of said indebtedness, the undersigned Successor Trustee {see Book No. 2374, at page 32 thereof} will offer for sale at the front door of the Wood County Courthouse, Parkersburg, West Virginia, on
THURSDAY, AUGUST 14, 2025,
at 10:00 o’clock in the forenoon, local time,
at public auction, to the highest bidder for cash, all of the right, title and interest of A.C.T. RENTALS, INC., a corporation, in and to the real property described in a certain deed of trust dated January 14, 2016, to TIMOTHY R. AIKEN, original Trustee, for the benefit of Union Bank, Inc., recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in General Lien Book No. 1905, at page 882 thereof, possessed by the said A.C.T. RENTALS, INC. as at the making of said deed of trust, which said real estate is described in said deed of trust as follows:
All of that certain lot, tract or parcel of real estate situate in Williams District, Wood County, West Virginia, more particularly bounded and described as follows:
BEGINNING in the center of Briscoe Run in the southerly right-of-way of U.S Route No. 21, thence N. 85 degrees 58 minutes W. 57 feet to a concrete monument; thence along said southerly right-of-way line 196 feet to a point; thence S. 11 degrees 25 minutes E. 350 feet to a point; thence S. 59 degrees 51 minutes E. 680 feet to a point; thence N. 40 degrees 3 minutes E. 605.9 feet to the middle of Briscoe Run; thence with the middle of Briscoe Run the following courses and distances: N. 70 degrees 10 minutes W. 220 feet; S. 66 degrees 50 minutes W. 155 feet; S. 77 degrees 25 minutes W. 310 feet; N. 10 degrees 40 minutes W. 203 feet; N. 54 degrees 28 minutes W. 128.2 feet to the place of beginning, containing eight (8) acres, more or less, the same being shown on a plat of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book No. 537, at page 440A, less and except a certain 0.20-acre tract conveyed to Patsy Minnite, Jr. and Judith R. Minnite, by deed dated January 28, 1970, and recorded in said Clerk’s Office in Deed Book No. 571, at page 196 thereof, that certain 1.10-acre tract conveyed to Patsy Minnite, Jr. and Judith R. Minnite by deed dated May 11, 1972, and recorded in said Clerk’s Office in Deed Book No. 599, at page 597 thereof.
Being the same real estate conveyed unto A.C.T. Rentals, Inc. by deed dated October 20, 1995 and of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 951, at page 382.
This conveyance is made subject to any and all exceptions, agreements, restrictions, covenants, easements and rights-of-way set forth in prior deeds of record.
Upon information and belief, the address of the subject real estate is 6250 Grand Central Avenue, Vienna, West Virginia 26105.
Upon the following terms to-wit:

2. A 10% buyer’s premium will be added to the highest bid achieved at the auction for the Real Property. The high bidder shall pay the buyer’s premium plus an additional 10% of its bid on the day of the sale (the “Good Faith Deposit”), with the balance to be paid in cash or check at closing within 14 days after the date of sale, or as the undersigned may otherwise agree.
3. The Trustee’s Sale will be open to online bidders in accordance with the auctioneer’s policies.
4. Subject to any and all reservations, exceptions, conditions, grants of rights of way and easements made by the grantor and its predecessors in title prior to the granting of the deed of trust being foreclosed upon.
5. The undersigned reserves the right to adjourn the sale from day to day and time to time upon oral proclamation made at the time and place of sale set forth herein or at such later time and place to which the sale has theretofore been adjourned, and further reserves the right to alter the terms of sale at any such continued sale.
6. The undersigned reserves the right to reject any and all bids.
7. Sale is subject to unpaid ad valorem taxes and special assessments, if any.
8. The premises described hereinabove, including any and all improvements thereto, are sold “AS IS-WHERE IS” with no warranty express or implied.
9. The owner and holder of the indebtedness secured by the deed of trust described hereinabove reserves the right to bid at this sale.
10. The successful buyer at the sale will be responsible for paying any and all transfer stamps, excise fees and recording costs with respect to the trustee’s deed.
11. Neither the owner and holder of the indebtedness secured by the underlying deed of trust nor the Trustee, nor anyone acting by or on behalf of the Trustee shall have any duty to cause any existing tenant or person or persons occupying the subject property to vacate said property.
12. Sale is subject to the provisions of W.Va. Code §38-1-16 regarding any existing residential tenancy at the subject premises.
13. Any personal belongings remaining in the subject premises after sale shall be deemed abandoned and may thereafter be disposed of at the successful bidder’s or bidders’ discretion. Any person or entity claiming ownership of or any interest in any such property should contact the undersigned prior to sale about any such claim.
14. The successful bidder at the sale and the Trustee shall execute a Memorandum of Sale at the conclusion of the sale, and the terms of the Memorandum shall control.
15. In the event that the successful bidder at the sale fails or refuses to consummate his, her, or its purchase, then the Trustee shall have the option to consummate sale with the next highest bidder at the sale.
16. Any additional terms announced prior to the sale shall control.
