The object of the above-entitled action is to subject real estate to payment of debts of the decedent Clay Duane Powell when the personal estate is insufficient for the payment of his debts. It appearing by affidavit filed in this action that counsel for Plaintiff, Richard D. Smith, Jr., has attempted to serve Defendant, Amber Powell, at her last known address via certified mail from the Circuit Court Clerk’s office pursuant to Rule 4(d)(1)(F) and by The Wood County Sheriff’s Office pursuant to Rule 4(d)(1)(D) of the West Virginia Rules of Civil Procedure, but the attempts of service for this defendant have been unsuccessful.
It is ordered that Amber Powell does serve upon the Wood County Circuit Court Clerk Celeste Ridgway at #2 Government Square, Parkersburg WV 26101 and Plaintiff, Estate of Clay Duane Powell, deceased, Anthony Powell, Administrator, via its attorney Richard D. Smith, Jr. at P.O. Box 2034, Parkersburg, WV 26102, an answer or other defense to the Complaint filed in this action on or before September 17, 2025, otherwise judgment by default will be taken against you at any time thereafter. A copy of said Complaint can be obtained from the undersigned Clerk’s office.
