MELLINGER, SHERIFF OF JACKSON COUNTY, WEST VIRGINIA Notice is hereby given to Michael L. Boggess Unknown Heirs, Karen Kay Harrouff, Robert Lewis Henry, Sr., William Edward Henry, Sr., Lois Jean Stone, Southern Jackson County Public Service District, Frontier West Virginia Inc., Columbia Gas Transmission, LLC, Unknown Persons/Owners, and Ross H. Mellinger, Sheriff of Jackson County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that, pursuant to W. Va. Code 54-1-1, et seq., and 54-2-1, et seq., and all applicable West Virginia statutes, a hearing to determine just compensation will be held on December 3, 2025, at 10:30 a.m., in this action in the Circuit Court of Jackson County, West Virginia, before Judge Lora Dyer in relation to a Petition for Condemnation/Right of Entry, which was filed and granted in the Circuit Court of Jackson County, West Virginia, and is known as Civil Action No. CC-18-2023-C-111, and styled AEP West Virginia Transmission Company, Inc. vs. Michael L. Boggess Unknown Heirs, et al. Said just compensation hearing will address real property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of AEP West Virginia Transmission Company, Inc. situate on the waters of Poca, and being in Ripley District, Jackson County, West Virginia, identified as Tax Map 59, Parcel 0063 0000 3001, and recorded in the office of the Clerk of the County Commission of Jackson County, West Virginia, in Deed Book FD99, at page 472, and being more specifically bounded and described as follows: Beginning at a point marked “A” on said plat; thence N. 291/2 E. 74 poles to a point in State Route No. 2; thence with said State Route No. 2 N. 53 W.45 poles to a point in State Route No. 2; thence leaving said State Route No. 2. S.40 W.67 poles to a stake in Bank’s line; thence N.661/2 W.30 poles to the place of Beginning, Containing 16 acres be the same more or less. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Jackson County Circuit Clerk’s office at 100 Court Street, Ripley, West Virginia, 25271, for the purposes of appearing and defending. The said Petition for Condemnation/Right of Entry may also be obtained from the attorneys for AEP West Virginia Transmission Company, Inc., Stephen F. Gandee, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301. The aforementioned respondents are further notified that, at the said hearing to determine just compensation on December 3, 2025, at 10:30 a.m., in the Circuit Court of Jackson County, West Virginia, located at 100 Court Street, Ripley, West Virginia, 25271, before the Honorable Lora Dyer and Commissioners, you may appear for hearing and presentation of evidence, and are notified that any failure to appear and/or present evidence may result in the waiver of any and all defenses or claims, if any, you may have regarding just compensation or otherwise in this action.
