This will give notice that TERRI L. SMITH and RUSSELL W. SMITH has filed a COMPLAINT in the Circuit Court of Wood County, West Virginia, to obtain an award against the Defendant, IVY M. MONEYPENNY, jointly and severally, for the debilitating and permanent injuries to TERRI L. SMITH and RUSSELL W. SMITH as a result of an automobile accident that occurred on 11/19/2024. Said injuries have caused Plaintiff, TERRI L. SMITH, a loss of enjoyment of life, lost income, loss of earning capacity, pain, and suffering and mental anguish. Plaintiff requests any relief a jury of the Defendant’s peers considered to be fair and just, punitive damages due to the nature of the Defendant’s conduct, plus pre-judgment interest, post-judgment interest and costs and any further relief appropriate under the facts and circumstances of this case.
TO THE ABOVE-NAMED DEFENDANT:
It appears by Affidavit filed in this action that Plaintiff has made a good faith effort to locate the Defendant in order to serve her with a Summons and Complaint in accordance with the Rules of Civil Procedure. Plaintiff has had considerable difficulty locating IVY M. MONEYPENNY as the Defendant, IVY M. MONEYPENNY, may not be residing at the address listed on the traffic report. Counsel has attempted service upon IVY M. MONEYPENNY via the services of the Wood County Clerk by Certified Mail which has resulted in Not Deliverable as Addressed and Unable to Forward.
It is ORDERED that IVY M. MONEYPENNY serve upon Richard D. Dunbar, Plaintiffs’ attorney, whose address is PO Box 123, Parkersburg, WV 26102, an Answer or other defense to the Complaint filed in this action on or before thirty (30) days from the date of this Publication. Otherwise, judgment by default will be taken against IVY M. MONEYPENNY at any time thereafter. A copy of said COMPLAINT can be obtained from the undersigned Clerk at his/her office.
