LEGAL NOTICE
NOTICE TO POSSIBLE CLAIMANTS OF TOBACCO AND VAPOR SHOP LOCATED AT 1501 HARRISON AVENUE, ELKINS, WV 26241, Parcel ID 42-10-00011-0004-0000, Leadsville District, and on record with the Randolph County Clerk in Deed Book 621, Page 658, and ONE THOUSAND NINE HUNDRED THIRTY SEVEN DOLLARS ($1,937.00) In United States Currency BY FIRST SERGEANT J.S. CHUMLEY AND SERGEANT J.M. TALLMAN OF THE MOUNTAIN REGION DRUG AND VIOLENT CRIMES TASK FORCE ON JUNE 5, 2025.
On or about May 28, 2025, First Sergeant J.S. Chumley and Sergeant J.M. Tallman of the West Virginia State Police and assigned to the Mountain Region Drug and Violent Crimes Task Force conducted an investigation regarding the Tobacco and Vapor Shop located at 1501 Harrison Avenue, Elkins, WV committing the offense of Possession with the Intent to Deliver a Controlled Substance, to wit; Marijuana, pursuant to W. Va. Code Section 60A-4-401(a)(ii) at the real property of Saleh W. Al-Mardeai and Saleh Abdo Ahemed Salem (known as Tobacco and Vapor Shop)located at 1501 Harrison Avenue, Elkins, WV 26241, Parcel ID 42-10-00011-0004-0000, Leadsville District and also seized $1,937.00 in United States Currency. Said property was found in the actual or constructive possession of Abbigayle Holsberry, employee of the Tobacco and Vapor Shop and, upon information and belief, the agent of Saleh W. Al-Mardeai and Saleh Abdo Ahemed Salem.
The Petitioners believe that the said real property of Saleh W. Al-Mardeai and Saleh Abdo Ahemed Salem (known as Tobacco and Vapor Shop) located at 1501 Harrison Avenue, Elkins, WV 26241, Parcel ID 42-10-00011-0004-0000, Leadsville District and $1,937.00 in United States Currency are subject to seizure and forfeiture, pursuant to the West Virginia Contraband Forfeiture Act (W. Va. Code Sections 60A-7-703 and 704), and that said Saleh W. Al-Mardeai and Saleh Abdo Ahemed Salem (known as Tobacco and Vapor Shop) located at 1501 Harrison Avenue, Elkins, WV 26241, Parcel ID 42-10-00011-0004-0000, Leadsville District and $1,937.00 in United States Currency were used to facilitate the sale, receipt, possession, manufacturing, possession with intent to deliver, and/or delivery of controlled substances in violation of Chapter 60A of the Code of West Virginia.
Petitioners seek an Order from the Circuit Court of Randolph County, West Virginia that the said real property of Saleh W. Al-Mardeai and Saleh Abdo Ahemed Salem (known as Tobacco and Vapor Shop) located at 1501 Harrison Avenue, Elkins, WV 26241, Parcel ID 42-10-00011-0004-0000, Leadsville District and $1,937.00 in United States Currency be forfeited to the State of West Virginia and ownership of said property be vested in the State of West Virginia; that, thereafter, it be disposed of according to law.
Any claimant to the above referenced property being Saleh W. Al-Mardeai and Saleh Abdo Ahemed Salem (known as Tobacco and Vapor Shop) located at 1501 Harrison Avenue, Elkins, WV 26241, Parcel ID 42-10-00011-0004-0000, Leadsville District and $1,937.00 in United States Currency has a right to file a claim on or before December 12, 2025. Any claim must clearly state the identity of the claimant and an address where legal process can be served upon them and must be filed with the Circuit Clerk of Randolph County, West Virginia.
