NOTICE OF SALE
UNDER DEED OF TRUST
Notice is hereby given that, under authority of a certain deed of trust hereinafter described, the undersigned Trustee will, at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on
November 17, 2025
11:00 a.m.
offer for sale certain property described in that certain deed of trust executed by DANIEL JAY MILLER and KRISTA I. MILLER to Jennifer L. Morgan and Rebecca L. McClung, as Trustees, which deed of trust is dated the 2nd day of June, 2022, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 620, at Page 583; and given to secure Mountain Valley Bank, N.A., the payment of a note therein described.
The premises subject to the above-described deed of trust, which premises will be sold at the above stated public auction known as 611 Hart Ranch Road and 10 Hart Ranch Road, Elkins, West Virginia, and being more fully described as follows:
TRACT ONE: All that certain tract or parcel of real estate situate in Beverly District, Randolph County, West Virginia, lying on the south side of Chenoweth Creek, designated as Lot 11B, and being more particularly bounded and described as follows:
“Beginning at corner 13 on plat, a set 5/8 inch by 36-inch rebar, corner to Lot 11A on the line of the southern portion of the Alice Hart remainder, thence with Lot 11A

Haddix by virtue of a deed dated March 12, 2005, and recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 501, at Page 91.
TRACT TWO: All of that certain tract or parcel of real estate, together with the improvements thereon and appurtenances thereunto belonging, situate in Beverly District, West Virginia County, West Virginia, being designated as Lot 10 on the plat filed in Deed Book 437 at page 552, and more particularly bounded and described as follows:
Beginning at corner 41 on plat, a found large chestnut stump, corner to Paugh, to Lot 9, and to the Alice Hart remainder, thence with the Hart remainder

LESS AND EXCEPT the following out conveyance from Daniel J. Miller aka Daniel J. Miller, Jr., and Krista I. Miller to Robert D. Wamsley and Dorothy H. Wamsley, by virtue of a deed dated February 20, 2020, and of record in the aforesaid Clerk’s Office in Deed Book 605, at Page 525, described as follows: a lot or parcel of land situate and adjacent to 541 Harts Ranch Road, Elkins, West Virginia, 0.2 miles south of the Chenoweth Creek Road and approximately 2.5 miles east of the Beverly 4- Lane, on the waters of Chenoweth Creek and on the south side thereof, Beverly District, Randolph County, West Virginia, more particularly

N 0 deg 19′ E 40.05 feet to Corner No. 1, the Beginning, containing a Gross Area of 12,213 square feet or 0.28 acre, as surveyed in January, 2020 by Leon G. Mallow of Leon G. Mallow Surveying, 2000 Piercy Road, Montrose, West Virginia.
“Subject to 20 feet wide right-of-way over the roadways along the western and northern boundaries of the above-described lot and subject to the other restrictions and covenants contained in Deed Book 596, at Page 87.”
This conveyance is made subject to any and all reservations, restrictions, exceptions, rights-of-way and easements as set forth in prior instruments of record in the chain of title to said real estate.
The above-described property will be sold subject to all reservations, restrictions, exceptions and conditions contained in all prior deeds conveying said real estate except those pertaining to race, color or creed, and subject to all unpaid levies and assessments including real estate taxes. TERMS OF SALE: Cash in hand on day of sale, or ten percent (10% down), or approved line of credit with closing to occur within thirty (30) days. Purchaser accepts subject real estate “AS IS”.
Said sale was originally scheduled for September 24, 2025. By Notice of Continuance dated September 24, 2025, sale was continued to October 29, 2025. By Notice of Continuance, dated October 29, 2025, said sale was continued to November 17, 2025.
The undersigned Substitute Trustee reserves the right to reject any and all bids received, and to continue said sale from time to time, upon announcement thereof given verbally, on day of sale and any continuance thereof.
