NOTICE OF SALE
UNDER DEED OF TRUST
Notice is hereby given that, under authority of a certain deed of trust hereinafter described, the undersigned Trustee will, at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on
February 25, 2026
11:30 a.m.
offer for sale certain property described in that certain deed of trust executed by NANCY H. DICIANNI to Jennifer L. Morgan and Matthew E. Osborne, as Trustees, which deed of trust is dated the 11th day of July, 2014, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 525, at Page 96 ; and given to secure Citizens Bank of West Virginia , the payment of a note therein described.
The premises subject to the above-described deed of trust, which premises will be sold at the above stated public auction all of those certain lots or parcels of real estate situate in the City of Elkins, Randolph County, West Virginia, in what is locally known as “Woolwine Hollow” and on Thorn Avenue (Street), together with any and all appurtenances and improvements situate thereon and thereunto belonging, and more particularly bounded and described as follows: Deeds as reference: DB 340/453; DB 233/402; DB 214/114).
FIRST TRACT: A tract containing 1 acre and 5,985 square feet; Tax Map 20, Parcel 0024, Elkins Corporation.
SECOND TRACT: A tract or lot, 24′ x 30′, containing 720 square feet, more or less; Tax Map 20, Parcel 0025, Elkins Corporation, and being situate on the west side of First Tract above described.
LESS OUT-CONVEYANCE from Nancy H. DiCianni to Frank Krienen and Anneke Krienen by Deed dated April 10, 2002, found of record in the Office of the Clerk of the Randolph County Commission of Randolph County, West Virginia, in Deed Book 483, at Page 538 described as follows:
That real estate situate in Elkins Corporation Taxing District, Randolph County, West Virginia, north of Thorn Avenue, south the Wees and Heavner Addition (DB84/498), together with any and all appurtenant easements which may benefit same:
BEGINNING AT a 5/8″ rebar set 94.75 feet from the northern boundary of Thorn Avenue in a line common to Souter DB 342/102; thence
S 63-24-42 W. 268.86′ leaving said Souter DB 342/102, traveling through DiCianni DB 451/507, which this is a part of, to a 5/8″ rebar set 61.91 feet from the northern boundary of Thorn Avenue; thence
N 34-34-31 W. 52.87′ traveling to a 5/8″ rebar set on the southern boundary of a 15- ft. alley, Wees and Heavner Addition DB 84/498; thence
N 49-43-03 E. 290.93′ traveling with the southern boundary of said 15-ft. alley, to a set 5/8″ rebar; thence
S 23-32-26 E. 121.40′ leaving said 15-ft. alley, traveling with a portion of a line common to Souter (DB 342/102), to the BEGINNING, containing 0.55 acre, more or less, as surveyed by Kenneth Kelly, Professional Surveyor No. 973 of Dailey, West Virginia, in February 2002, and as depicted on a plat of survey recorded in Plat Cabinet D, Slide D-15.
TOGETHER WITH a 14-ft. right-of-way across lands reserved unto Nancy DiCianni for purposes of gaining access to the property herein conveyed from Thorn Avenue, as depicted on the plat of survey.
And being the same real estate conveyed to Nancy H. DiCianni from virtue of a deed from Joshua H. Small, Jr. and Donna A. Small, dated April 7, 1997, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 451, at Page 507.
This conveyance is made subject to any and all reservations, restrictions, exceptions, rights-of-way and easements as set forth in prior instruments of record in the chain of title to said real estate.
The above-described property will be sold subject to all reservations, restrictions, exceptions and conditions contained in all prior deeds conveying said real estate except those pertaining to race, color or creed, and subject to all unpaid levies and assessments including real estate taxes.
TERMS OF SALE: Cash in hand on day of sale, or ten percent (10% down), or approved line of credit with closing to occur within thirty (30) days. Purchaser accepts subject real estate “AS IS”.
The undersigned Trustee reserves the right to reject any and all bids received, and to continue said sale from time to time, upon announcement thereof given verbally, on day of sale and any continuance thereof.
