Pursuant to Rule 4(e)(1)of the West Virginia Rules of Civil Procedure, this ORDER OF PUBLICATION is hereby filed to notify the Defendant JUSTIN PRESLEY of the pending civil action filed against him in Civil Action No. CC-54-2026-C-76:
1. Defendant JUSTIN PRESLEY has been sued by Plaintiffs JANE GRAHAM and LOIS TAYLOR for claims of negligence arising out of a incident involving his dog that occurred on October 30, 2025, on Woodland Park Drive in Parkersburg, Wood County, West Virginia. Both Plaintiffs allege:
2. That on or about said time and place, Defendant negligently permitted his dog to exit his residence unattended, leave his property, enter the street, and attack and bite Plaintiff Graham’s dog.
3. That during this vicious and brutal attack by the Defendant’s dog, Defendant’s dog caused injuries to Plaintiff Graham.
4. That during this attack, Plaintiff Taylor exited her residence to render aid to Plaintiff Graham.
5. That during this vicious and brutal attack by the Defendant’s dog, Defendant’s dog caused injuries to Plaintiff Taylor.
Both Plaintiffs Graham and Taylor are represented by The Law Office of Jay W. Gerber, Jr., PLLC, of 813 Grand Central Avenue, Vienna, WV 26105.
A copy of the Plaintiff’s Amended complaint may be obtained in the Wood County Circuit Clerk’s office located at #2 Gov’t Square, 1st floor, Parkersburg, WV.
Defendant JUSTIN PRESLEY must appear and defend on or before 30 from the date of this order. If no appearance is made, judgment may be had against the Defendant.
