NOTICE

Notice is hereby given that the above-styled matter has been filed in the Circuit Court of Wood County, West Virginia, pursuant to the West Virginia Code 7-1-3ff(h) and the Wood County West Virginia, Abandoned and Dilapidated Building Ordinance, West Virginia Common Law, and Rule 65 of the West Virginia of Civil Procedure. Any person or corporation having a claim to the hereinafter described property shall, on or before the 30th day of October, 2020 file, in writing, their claim to said property with the Clerk of said Court, which said claim must clearly state the identity of the claimant and an address where legal process can be served upon such person or corporation. A copy of said claim shall be delivered to Patrick O. Lefebure, Prosecuting Attorney, Counsel for Petitioners, at the Office of the Wood County Prosecuting Attorney, Judge Donald Black Annex, 317 Market Street, Parkersburg, West Virginia 26101.
Pursuant to West Virginia Code 7-1-3ff(h), and the Wood County West Virginia, Abandoned and Dilapidated Building Ordinance, West Virginia Common Law, and Rule 65 of the West Virginia of Civil Procedure the following information is given: (1) the property to be condemned which is the subject of the petition filed is 1003 N. Power Avenue, Parkersburg, West Virginia; (2) the Respondents’ have been given adequate notice to correct the issues with the property which have made said property unsafe and be a public nuisance; (3) the Respondents are the only owners of the property subject to Petitioners; and (4); a request to the above named Court to enter an Order directing that the Respondent’s be responsible for all cost incurred by the Petition with response to the property and attorney fees and Court costs incurred bringing this action pursuant to Virginia Code 7-1-3ff(h), and the Abandoned and Dilapidated Building Ordinance Section 3.1(h)(D) and (E).
Please take notice the undersigned will bring the above matter on for hearing before the Honorable Robert A. Waters, Judge of the Circuit Court, in his chambers situate Wood County Judicial Annex, Parkersburg, Wood County, West Virginia on the 4th day of December, 2020 at 3:00 o’clock p.m., or as soon thereafter as may be heard.
