NOTICE OF TRUSTEE’S SALE

By virtue of the authority vested under a certain Deed of Trust dated September 23, 2016, conveyed by Chad True to Ingeborg Chenoweth as Trustee recorded in the Office of the Clerk of County Commission of Wood County, West Virginia, in General Lien Book 1937 at page 644 which secures Richard A. Reynolds, and default having been made in the payment of the indebtedness secured by said Deed of Trust, and being instructed by the secured party to foreclose, there under, the Trustee by the undersigned lawyer will offer for sell at public auction, to the highest bidder, at the front door of the Wood County Courthouse, in Parkersburg, West Virginia, on the 11th day of December 2020, at 10 o’clock a.m. on that day, all that certain lot, tract, or parcel of land situate in Clay District, Wood County, State of West Virginia, described as follows:

Being all of Lot No. 290 Community Acres Second Addition, as shown on a recorded plat in The Office of the Clerk of the County Commission of Wood County, West Virginia in Plat Book 17 at page 14.
At the time the deed of trust was executed the mailing address of this property was reported to be 290 Ash Circle, Davisville, WV 26142. However, that mailing address has reportedly been updated by the post office to 56 Ash Circle, Davisville, WV 26142.
Being the same real estate conveyed to Chad True by Richard A. Reynolds by deed dated 9/23/2016 and recorded in the aforesaid clerk’s office in Deed Book 1252 at page 869.

The referenced real estate will be sold with no covenants of warranty, and subject to all covenants, restrictions, reservations, easements, rights of way, leases and reservations which may be a matter of record or visible upon the ground with priority over said referenced deed of trust, and subject to all liens and encumbrances with priority to the subject trust deed, including, without limitation, deeds of trusts, judgments, liens for real estate taxes, covenants, homeowner association fees or restrictions, utility easements and conditions of record. The purchasers at the sale shall be responsible for paying all recording costs. The sale shall be subject to unpaid real estate taxes. The deed to purchaser will be in the form set forth in WV Code 38-1-6. The sale is also subject to those facts which would be disclosed by visual examination, survey, title examination or environmental audit.

The subject property will be sold in “AS IS” condition. The Trustee is under no duty to cause any person to vacate the subject premises. Any and all bids my be rejected.

TERMS: $5,000.00 in cash and/or certified funds as deposit with the balance due and payable at closing within 20 days following the sale. The party secured by the deed of trust may purchase at such sale by credit against the balnace due on the deed of trust.

The sale may be postponed on the day of sale by public announcement at the time and place designated or by posting notice of the same at the Wood County Courthouse.
