American Disposal Services of West Virginia, Inc., DBA Short Creek Landfill, a solid waste facility, Wheeling, Ohio County, Tariff application to include certain language is existing tariff.

NOTICE OF FILING
On August 3, 2015, American Disposal Services of West Virginia, Inc., dba Short Creek Landfill (Short Creek) filed a request to modify a portion of its current tariff. Specifically, Short Creek seeks to add language that would allow it to negotiate with customers seeking to dispose of waste that Short Creek believes requires special handling. The negotiable terms would include (i) the volume of waste accepted, (ii) the details of disposal and (iii) the price of disposal. Short Creek also included a list of sixteen categories of waste it seeks to designate as requiring special handling. Finally, Short Creek seeks a negotiable surcharge for waste in vehicles requiring “other than normal or ordinary landfill assistance.”

The proposed categories of waste requiring special handling include: (1) shredder fluff, insulation and similar light-weight wastes, (2) ash, (3) stabilized liquids, (4) drums, (5) sludges, (6) PCBs in concentration of 50 ppm or less, (7) pesticide containers, (8) animal carcasses, (9) contaminated soil, (10) baled waste, (11) construction demolition debris, (12) non-hazardous industrial, (13) agricultural, (14) carbon black, (15) non-infectious and (16) any and all other wastes and materials identified as special wastes by the West Virginia Department of Environmental Protection.

The tariff application is currently available for inspection at the offices of the Commission or online. Anyone desiring to protest or intervene should file a written protest or request to intervene within thirty days following the date of the publication unless otherwise modified by Commission Order. Requests to intervene must comply with the Commission rules on intervention set forth in the Commission Rules of Practice and Procedure.
