NOTICE OF
SUBSTITUTE TRUSTEE’S SALE OF VALUABLE REAL ESTATE

Notice is hereby given that the undersigned Substitute Trustee, appointed by document dated November 5, 2018, and of record in the Office of the Clerk of the Marshall County Commission in Deed of Trust Book 1036, at page 131, will sell at public auction to the highest bidder on:
March 19, 2021, at 10:00 a.m., at the front door of the Marshall County Courthouse, 600 Seventh Street, Moundsville, West Virginia, that certain property conveyed by Shar J. Mason to Ronal W. Rush, Trustee, by Deed of Trust dated May 26, 2015, and recorded in the office of the said Clerk of the County Commission of Marshall County, West Virginia, in Deed of Trust Book 962, at page 1, and being described as follows:
Three certain tracts or parcels of land situate in Washington District, Marshall County, West Virginia, bounded and described as follows:

First: Beginning at the southeast corner of a tract conveyed by Samuel Dorsey and wife to Bessie S. Parriott by deed bearing date the 3rd day of July, 1922; thence North 15* 10′ West 583 feet to the center of the Waynesburg Pike; thence with said pike North 53* 45′ East 107 feet to a point in center of said pike; thence leaving the pike South 15* 10′ East 617 feet to a stake; thence South 72* West 100.4 feet to the place of beginning, containing 1.377 acres according to a survey made by Wilbert Jones, C.E. June 20, 1922.

Second: Beginning at an iron stake (gas pipe) on the present line between properties belonging to William T. Beam and W. B. Pack, Jr.; thence South 21* 15′ East 427 feet to a stake in the Dorsey line; thence with the Dorsey line South 38* 30′ West 55 feet to a post in said line and the original corner of properties of above named parties; thence following the original line North 15* 10′ West 456 feet to the place of beginning, containing two hundred twenty-two one- thousandths (0.222) of an acre according to a survey and plat made by Wilbert Jones, C.E., 1926.

Third: Beginning at a mark on the edge of a two inch plank connecting the two garages on the properties of William T. Beam and James D. Parriott, said mark indicated by a spike driven in said plank above an iron pin in the ground below, 2.5 feet from the northeast corner of the Parriott garage and 5.7 feet from the northwest corner of the Beam garage; thence North 20* 10′ West 223 feet to the center of the Waynesburg Pike; thence with the center of said pike North 54* 30′ East 21.5 feet to a point in the center of said pike; thence South 15* 10′ East 229 feet to the place of beginning, containing fifty-two thousandths (.052) of an acre according to survey made by Wilbert Jones, C.C. 1926.

There is excepted from this grant that certain parcel of land which was conveyed by William T. Beam and Nelle Beam, his wife, to James D. Parriott, by deed dated July 14, 1926, and recorded in the said Clerk’s office in Deed Book 182, at page 217, and that certain parcel of land which was conveyed by the said parties to W.B. Pack, Jr., by Deed dated July 14, 1926, and recorded in the said Clerk’s office in Deed Book 182, at page 97.

Being the same property conveyed to Michael L. Mason and Shar J. Mason from Security National Trust Company, Successor and Conservator for Wanda J. Yannen, by Deed dated September 28, 2011, and recorded in Marshall County Deed Book 746, at page 605. Also by Deed from Michael L. Mason and Shar J. Mason, divorced, to Shar J. Mason, divorced, dated October 22, 2014, and recorded in Marshall County Deed Book 845, at page 588.

The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record if any pertaining to said real estate; (2) any and all unpaid taxes assessed against said property; (3) the subject property will be sold in “as is” condition; (4) the Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property; (5) the Substitute Trustee will deliver a Substitute Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Substitute Trustee makes no representations and warranties about the title of the real estate to be conveyed.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Substitute Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
