NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated December 14, 1998, executed by Borrower(s), Mishi M Ewashkow and Robert L Ewashkow, to Douglas C. McElwee, the Trustee of record in the office of the Clerk of the County Commission of Randolph County, West Virginia, in Book 296, at Page 763. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 143 B Files Creek Rd, Beverly, WV 26253. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated January 6, 2021, of record in the Clerk’s Office in Book 599, Page 317. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Randolph County, in Elkins, West Virginia, on the following date:

June 1, 2021 at 2:15 P.M.

A tract or parcel of real estate situated in Beverly District, Randolph County, West Virginia, south of Secondary Route 37/8, Files Creek Road, more particularly bounded and described as follows:

Beginning at a 5/8″ rebar set in a line common to Varner DB 445/680, said rebar bears S 14* 12′ 52″ W. +193.17 ft. from the southern edge of Secondary Route 37/8, Files Creek Road; thence

S 76* 02′ 40″ E 72.46′ leaving said Varner DB 445/680, traveling into Pritt WB 15/208, which this a part of, to a set 5/8″ rebar; thence

S 13* 57′ 20″ W 130.00′ traveling to a 5/8″ rebar set on the northern boundary of a proposed 20 ft. right-of-way; thence

N 76* 02′ 40″ W 72.46′ traveling with the northern boundary of said proposed 20 ft. right-of-way a line to a 5/8″ rebar set in a line common to Varner DB 445/680; thence

N 13* 57′ 20″ E 130.00′ traveling with a portion of a line common to Varner DB 445/680, to the beginning.

Containing 9,419.50 sq. ft., more or less, as surveyed by Kenneth Kelly, Professional Surveyor No. 973, of Dailey, WV, in October 1998, as shown on a plat attached to the deed of conveyance from Lloyd H. Pritt to Robert Ewashkow and Mishi Ewashkow, dated the 14th day of November 1998, and recorded in the Office of the Clerk of the County Commission of Randolph County. West Virginia, in Deed Book No. 463 at Page 361.

Grantor conveys a non-exclusive right of use of the 20′ proposed road right of way depicted on the attached plat of survey, providing ingress and egress to the property hereby conveyed.

The aforementioned property containing a 1999 fabricated home, 44 x28, HeritagePT, bearing V.I.N. Number VAFLW19A02197HE13.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code ยง 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
