NOTICE OF SUBSTITUTE TRUSTEE SALE

WHEREAS, by virtue of a trust deed dated June 23, 2016, made by Ace Homebuyers, LLC, a West Virginia Limited Liability Company to Timothy R. Aiken, Trustee, of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Trust Deed Book 2012, page 217, said Trustee was empowered to sell the hereinafter described real estate pursuant to the terms and conditions set out in said deed of trust; and
WHEREAS, the said Trustee having been substituted by an Appointment of Substitute Trustee, dated the 21st day of May, 2021, recorded the 25th day of May, 2021, in the aforesaid Clerk’s office, in Trust Deed Book 2180, page 410, and executed by Jeremy Webb, its Vice President, and the undersigned Trustee, Robert D. Fisher, having been substituted therein by said Appointment of Substitute Trustee, and the granter of the deed of trust having defaulted in the payment of a note secured thereby and the undersigned Trustee having been directed by the holder of said note to sell the real estate securing said note.
The undersigned Substitute Trustee will sell at public auction on
July 19, 2021, commencing at 11:30 p.m.
at the front door of the Old Courthouse (facing Judicial Annex), situate in the City of Parkersburg, Wood County, West Virginia, all of that certain lot, tract or parcel of real estate, situate, lying and being in the City of Parkersburg, Wood County, West Virginia, more particularly bounded and described as follows:

Being all of Lots Nos Sixty-One (61) and Sixty-Two (62) in what is known as Holmes Park Addition to the City of Parkersburg, as shown on a revised plat of said addition of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book No. 5, page 30, to which reference is hereby had and made for a more particular description of said lots.

This is the same real estate conveyed unto Ace Homebuyers, LLC by 3603 Land Trust, by Ace Homebuyers, LLC, Trustee, by deed dated June 23, 2017, of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 1274, page 501.

Thereafter, by deed dated October 30, 2020, of record in the aforesaid Clerk’s office in Deed Book 1314, page 387, Ace Home- buyers, LLC, a West Virginia Limited Liability Company conveyed the above described real estate unto Jeffery E. Casto.

There is EXCEPTED AND RESERVED and will not be conveyed all that certain portion of Lot No. 62 heretofore conveyed to Stephen A. McGinnis et ux by deed dated May 11, 1976, recorded in said Clerk’s Office in Deed Book No. 669, at page 59 and that certain portion of Lots Nos. 61 and 62 conveyed unto Stephen A. McGinnis and Brenda J. McGinnis by deed dated July 14, 2014 and of record in the aforesaid Clerk’s Office in Deed Book 1217 at page 136.

It is understood that the 20 foot alley referred to in the Deed from Brookside Development Company to Mary E. McGinnis, running along the southerly line of said Lot No. Sixty-One (61) shall continue to be used as a public alley, as laid out on the plat aforesaid.

Subject to the building restrictions and restrictive coven- ants more fully set forth in said deed from Brookside Development Company, a corporation, to Mary E. McGinnis, dated May 6, 1940, recorded in the aforesaid Clerk’s Office in Deed Book 227, page 263.

This sale is made subject to all oil, gas and other mineral reservations and sales, to all valid existing rights of way and easements and appearing of record.
This sale is made subject to all unpaid real estate taxes.
The undersigned trustee reserves the right to adjourn the sale from time to time by oral proclamation or other announcement at the aforesaid place of sale.
