The Department of Environmental Protection is proposing to modify:

GENERAL WV/NPDES WATER POLLUTION CONTROL PERMIT STORMWATER

ASSOCIATED WITH CONSTRUCTION ACTIVITIES WV/NPDES PERMIT NO. WV0115924

Activity:

To Modify Storm Water General Permit based upon agreed Settlement Order 19-03-EQB and 19-06-EQB.

Justification:

In accordance with the Order for Appeal Nos. 19-03-EQB and 19-04-EQB issued by the WV Environmental Quality Board, the Department of Environmental Protection agreed to modify Permit No. WV0115924 in a settlement agreement on May 31, 2019

The Draft Permit and Settlement Agreement may be reviewed at: (https://dep.wv.gov/WWE/Programs/stormwater/csw/Pages/home.aspx).

If internet access is not available, please contact the Public Information Office for copies of the documents. The documents may be inspected, by appointment, at the Division of Water and Waste Management Public Information Office, at 601 57th Street SE, Charleston, WV, between 8:00 a.m. and 4:00 p.m. on business days starting 8/9/2019 through 9/3/2019.

Any interested person may submit written comments on the draft permit modification by addressing such to the address below within 30 days of the date of the public notice. Such comments should be addressed to:

The public comment period begins 8/9/2019 and ends 9/13/2019.

Comments received within this period will be considered prior to acting on the permit modification application. Correspondence should include the name, address and the telephone number of the writer and a concise statement of the nature of the issues raised.
