RE: Probate/dissolution Statement for Smithers Volunteer Fire Department, INC.
To Whom It May Concern,
This letter serves as formal notice regarding the status and disposition of the Smithers Volunteer Fire Department, Inc., a nonprofit organization previously operating in the City of Smithers, Fayette County, West Virginia.
The Smithers Volunteer Fire Department, Inc. was organized as a nonprofit corporation under section 501©(3) of the internal Revenue Code. Effective December 3, 2025, the department was officially decertified by the West Virgina Stare Fire Marshal's Office and is no longer authorized to operate as a fire department within the state of West Virginia.
Due to this decertification, the organization has ceased operations and is proceeding with a dissolution in accordance with West Virgina state law and federal regulations governing nonprofit entities.
As part of this process, all remaining assets, after satisfaction of any outstanding debts and obligations, shall be distributed exclusively to public safety, or governmental purposes/entities consistent with the requirements of a 501©(3), or to a governmental agency.
This letter is intended to document the cessation of operations and to support any probate, audit, or administrative proceedings related to the dissolution of the Smithers Volunteer Fire Department, Inc. All outstanding debits should be submitted for payments prior to June 30, 2026
