Petition for consent and approval of landfill disposal capacity contract between LCS Services, Inc. and Allied Waste Services of North America, LLC, dba Republic Services of West Virginia.

On February 18, 2022, Allied Waste Service of North America dba Republic Services of West Virginia (Republic) and LCS Services, Inc. (LCS) petitioned the Commission for consent and approval of a landfill capacity contract between Republic and LCS which would allow Republic to dispose up to 35 tons per day of non-hazardous solid waste at the landfill. Staff has recommended approval of the petition for a capacity contract, without necessarily approving the specific terms and conditions.

Any protests to the petition for approval of the capacity contract or any petition to intervene in the proceeding are to be made by filing such protests or petitions to intervene with the Executive Secretary, Public Service Commission, P.O. Box 812, Charleston, WV 25323, within ten (10) days of the date of publication. If the Commission receives no protests or petitions to intervene, it may approve the increase in the capacity contract without further notice or hearing.
