TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated September 26, 2005, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50195469, in Book No. 5019, at Page 5469, Susan M. Boggs and Gilbert N Boggs, Jr. did convey unto Philip Hereford, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated June 23, 2014 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Caliber Home Loans, Inc. to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on September 10, 2015 at 12:15 p.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Shady Spring District, Raleigh County, West Virginia, and more particularly described as follows: Those certain tracts or parcels of land situated on Sullivan Road, Shady Spring District, Raleigh County, West Virginia, identified as Lots 4A and 4b and a 50 Foot Right-of-Way on a map entitled “PLAT OF SURVEY FOR JAMES PRINCE, John L. Cox LLS 455 SU, July, 1998,”said tracts being more particularly described as follows: Lot 4A: Beginning at the northeastern corner of Ward Park Subdivision, found steel pipe in the southern right-of-way of West Virginia Route 25 or Sullivan Road, thence with said right-of-way; N 86 25′ E 122.19′ to the Western line of a newly reserved 50 ft right-of-way, thence with said new right of way and through Lot 4 of the Etta Prince survey dated March, 1998: S 8 11′ E 89.30 to the northeastern corner of Lot 4b, set steel pipe; thence with Lot 3b: S 86 06′ W 132.56′ to the eastern line of Ward Park, thence with same: N 1 32′ W 89.81′ to the beginning, containing 11386 square feet or 0.26 acre. Lot 4B: Beginning at the southwestern corner of Lot 4a, set steel pipe in the eastern line of Ward park, thence with the southern line of Lot 4a: N 86 06’E 132.56′ to a 50ft right-of-way; thence with same: S 8 11′ E 78.39′ to the northeastern corner of Lot 4c; thence with same: S 87 21′ W 141.55′ to the eastern line of Ward Park; thence with same: N 1 32′ W 75.14′ to the beginning, containing 10498 square feet or 0.24 acres. There is GRANTED and CONVEYED, a 50 foot right of way as identified on a map entitled “PLAT OF SURVEY FOR JAMES PRINCE, John L. Cox LLS 455 SU, July, 1998, which is described in a deed dated December 29, 1998, from James E. Prince, to Prince Management Corp., a corporation, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia on roll 149, at Page 2322. And being the same property acquired by Gilbert N. Boggs, Jr. And Susan P. Boggs, husband and wife, by deed dated March 28, 2000, from Prince Management Corporation, a corporation, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5001, at Page 9832. A copy of any notice of foreclosure sale shall be served on Grantors by certified mail, return receipt requested at the following address: 1025 Sullivan Road, Glen Morgan, WV 25847, or such other address as may be given to Lender in writing by Grantors subsequent to the execution and delivery of this deed of trust. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1025 Sullivan Road, Glen Moargan, WV 25847 aka 1025 Sullivan Road, Glen Morgan, WV 25813. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $5,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
