The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated December 18, 2014, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Document No. 201400014807, in Book No. 1105, at Page 653, and re-recorded in Document No. 201500002422, in Book No. 1110, at Page 163, Carl Bradley Sinsel and Sara M Sinsel did convey unto RIchard A. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated September 5, 2019, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Branch Banking and Trust Company to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse in Fairmont, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Farmington Lincoln District, Marion County, West Virginia, and more particularly described as follows:
All of those certain tracts or parcels of real estate situate in the Town of Farmington, Lincoln District, Marion County, West Virginia, described as follows:
First Parcel: Beginning at a point in the Northerly right of way line of U.S. Highway No. 250, corner to and following the Fairmont and Mannington Railroad Company’s right of way line (said railroad line now being abandoned), N. 69° 45′ E. 55 feet to a stake in said railroad right of way line; thence continuing with said railroad right of way line, N. 84° 00′ E. 41.15 feet to a stake, corner to property now or formerly owned by Peter J. Bonasso; thence with Bonasso’s line, S. 27° 48′ W. 58.08 feet to a stake in the Northerly right of way line of U. S. Highway No. 250; and thence with the Northerly right of way of U. S. Highway No. 250, N. 65° 20′ W. 82 feet to the place of beginning, containing 2410 square feet, more or less; being the same real estate conveyed to Phillip Erdeljac and Theresa Erdeljac, husband and wife, by Peter J. Bonasso and Jane C. Bonasso, by deed dated August 6, 1956, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book No. 576, at Page 35, and by correction deed dated March 1, 1985, of record in said Clerk’s Office in Deed Book No. 860, at Page 411.
Second Parcel: Beginning at a track spike in U. S. Route 250, corner to other Erdeljac land, and running thence with Erdeljac line, N. 33° 25′ E. 60.16 feet to a track spike; thence with another line of Erdeljac, S. 866 58′ E. 11.02 feet to a track spike; thence S. 33° 26′ W. 65.73 feet to a track spike in U. S. Route 250; and thence with U. S. Route 250, N. 56° 38′ W. 9.49 feet to the place of beginning, containing 0.01 acre, more or less; being the same real estate conveyed to Phillip Erdeljac and Theresa Erdeljac, husband and wife, by Robert D. Dudash and Linda J. Dudash, husband an wife, by deed dated July 6, 1988, of record in said Clerk’s Office in Deed Book No. 879, at Page 367. A map or plat of the above parcel, designated as Parcel A, is attached to said deed.
Second Parcel is subject to the provisions of that certain interpartes deed between Robert D. Dudash and Linda J. Dudash to Phillip Erdeljac and Theresa Erdeljac dated August 31, 1994, of record in said Clerk’s Office in Deed Book No. 922, at Page 293.
Third Parcel: Beginning at a point in the Northern existing right of way line of U. S. Route 250, said point being 40 feet radially right of Center Station 203 + 50; thence, Northeasterly with said existing right of way line being a radial line to right 5 feet to a point in the Northern existing right of way line of U. S. Route 250, said point being 45 feet radially right of Centerline Station 203 + 50; thence, continuing with said existing right of way line Northwesterly 20 feet to a point in the Northern existing street car right of way line, said point being 45 feet radially right of Centerline Station 203 +70; thence Northeasterly with a curve to the right also Southeasterly with said existing street car right of way line 190 feet to a point in the Southern existing street car right of way line; thence Southwesterly with said division line 20 feet, more or less, to a point in the Southern existing street car right of way line; thence Northwesterly with a curve to the left with said existing street car right of way line in a re4verse centerline direction 160 feet, more or less; being the same real estate conveyed to Phillip Erdeljac and Theresa Erdeljac, husband and wife, by W. A. Dodd and Jean Dodd, husband and wife, by Deed dated January 15, 1976, of record in said Clerk’s Office in Deed Book No. 791, at Page 465.
Theresa Erdeljac dies July 5, 2011, leaving Phillip (G.) Erdeljac as sole owner of said real estate. Phillip G. Erdeljac died March 24, 2014, and by his last will and testament, duly admitted to probate, and of record in said Clerk’s Office in Will Book No. 140, at Page 823, devised said real estate to his Four children, Renee Denise Duckworth, Phillip J. Erdeljac, John David Erdeljac, and Joseph Thomas Erdeljac.
This conveyance is subject to the exceptions, reservations, rights of way, and conditions, of record, affecting said real estate.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 3214 Husky Hwy, Farmington, WV 26571.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $4000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
