The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated April 29, 2003, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed of Trust Book 765, at Page 1060, Cheryl Marie Cinalli and James L. Cinalli did convey unto David G. Underwood, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Richard A. Pill as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse, in Fairmont, West Virginia, on
October 29, 2019, at 2:18 PM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Fairmont City/Union District, Marion County, West Virginia, and more particularly described as follows:
PARCEL NO. 1:
BEGINNING at a point on the southern boundary line of View Avenue and a corner to Parcel B on said map and running thence with View Avenue N. 80° 30′ E. 49.50 feet to a stake; thence S. 10″ E. 60 feet to a stake; thence S. 80° 30′ W. 49.50 feet to a stake, a corner to Lots A and B on said map; thence with the line of Lot B N. 10° W. 60 feet to the place of beginning.
PARCEL NO. 2:
BEGINNING at a point a corner to parcel A and B on said map and running thence N. 80° 30′ W. 49.50 feet to a stake; thence S. 10° E. 60 feet to a stake; thence S. 80° 30′ W. 49.50 feet to a stake, a corner to Lot No. 42 on said map; thence with the line of Lot A N. 10° W. 60 feet to the place of beginning.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 800 View Avenue, Fairmont, WV 26554
AND BEING the same real estate which was conveyed to Cheryl Marie Cinalli and James L. Cinalli by Deed dated May 26, 1977, from Alphonse Carlone, and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book,804 at Page 40 and Deed Book 804, at Page 43.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
