Trustee’s Sale of Valuable Real Estate

TRUSTEE’S SALE
OF
VALUABLE REAL ESTATE
The undersigned  Substitute Trustee will, by virtue of authority vested in him by that certain Trust Deed dated July 9, 2020 by and between JONATHAN L. SIMMONS  to Jerry D. Moore and Jared T. Moore, Trustees, securing the Pendleton Community Bank, Inc. in the payment of a certain Promissory Note, said Note now in default, and said Trust Deed of record in the Office of the Clerk of the County Court of Pendleton County, West Virginia, in Trust Deed Book 164 at page 522,  on
FRIDAY, JUNE 6,  2025
beginning at 12:00 Noon,  of that day at the front steps to the Pendleton County Courthouse, Franklin,  West Virginia,  offer for sale at Public Auction to the highest bidder the following described real estate:
That certain tract or parcel of real estate lying and being situate on the east side of the Propst Gap Road approximately one-half mile south of Franklin in Franklin District of Pendleton County, West Virginia, and more particularly described as follows:
BEGINNING at a post on the east side of the Propst Gap Road and north of a private road, thence along east side of the Propst Gap Road N. 1° 15’ E. 166 feet to a post in an old line; thence, with the old line S. 86° 45’ E. 119 feet to a stake in said line; thence leaving old line S. 12° 09’ W. 194 feet to a stake; thence along north side of a private road N. 70° 00’ W. 87 feet to the place of beginning, containing 0.417 acre, more or less.
This is the same real estate that was conveyed by Enos Horst and Deborah P. Horst to Jonathan Simmons by Deed dated July 9, 2020 and of record in the Office of the Clerk of the County Commission of Pendleton County, West Virginia, in Deed Book 212, Page 249.
The Grantor further grants and conveys unto the Grantee, and his assigns, all rights of way and easements appertaining to the aforesaid real estate and being made subject to all exceptions, reservations, covenants, conditions, easements, and right-of-ways created or mentioned in prior instruments of record affecting the property herein conveyed.
Said Substitute Trustee was duly appointed by instrument dated April 29, 2025  and of record in the Pendleton  County Clerk’s Office in Trust Deed Book 181 at page 11.
The real estate taxes are assessed on the 2024 Pendleton County Land Records in Franklin  District on Tax Map 28, Parcel 21.1.
Reference is hereby made to all instruments in the chain of title for any and all pertinent purposes.
The subject property will be sold in “AS IS” condition.    The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of  120 days from the date of such sale or the period allowable for redemption under local law,  whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale.  The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
TERMS OF SALE
$5,000.00 on day of sale and balance upon closing, not to exceed thirty days.    Announcements made at sale take precedence over any written notice or advertisement.
