The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated March 9, 2004, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed of Trust Book 1191, at Page 61, and rerecorded in Deed of Trust Book 1246, at Page 68, and by Extension in Deed of Trust Book 1909, at Page 863, Retro Canyon, LLC did convey unto David G. Palmer and Gerald M. Titus, Jr., Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse, in Parkersburg, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Tygart District, Wood County, West Virginia, and more particularly described as follows:

 

Situate in the District of Tygart, County of Wood, and the State of West Virginia, more particularly bounded and described as follows:

PARCEL ONE:

BEGINNING at a point in the southerly line of Blair Avenue, 350.48 feet west of the intersection of the southerly line of Blair Avenue and the easterly line of the O. H. Blair 44.62 acre tract, a common line of the George Hendrickás tract, said point being the northwest corner of a lot 100.14 by 150 conveyed by Ora Harold Blair, single, to Paul d. Kelly, et ux, by deed dated September 17, 1963; thence southeasterly 150 feet, more or less, to a point in the westerly line of said Kelly lot to a point in the northerly line of Park View Drive; thence South 56õ 01á West 100 feet with said Park View Drive to a point; thence northwesterly 150 feet, more or less, to a point in the southerly line of Blair Avenue to the place of beginning, which said lot, tract or parcel of land is shown on a plat of Blair Park Addition No. 1 Revision, recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book 12, at page 31.

PARCEL TWO:

BEGINNING at a point 450.48á west of the intersection of the southerly line of Blair Avenue and the easterly line of the O. H. Blair 44.62 acre tract, a common line of George Hendrickás tract, said point being the northwest corner of lot conveyed by O. H. Blair, single, to Leora Full by Deed dated October 12, 1963, and recorded in Deed Book No. 482 at page 187; thence south along Fullás west line, 150 feet, more or less, to a point in the northerly line of Park View Drive; thence south 56õ 01á W. 80 feet, more or less, with said Park View Drive to a point; thence north on a line parallel to Fullás west line, 150 feet, more or less, to a point in the southerly line of Blair Avenue; thence N. 56õ 01á E. 80 feet, more or less, to the place of beginning.

PARCEL THREE:

BEGINNING at a stake set at the northeast corner of a lot conveyed to Robert G. Matheny, et ux, by O. H. Blair, single, by Deed dated June 22, 1962, recorded in the aforesaid Clerkás Office in Deed Book 467, at page 294 (now owned by Kenneth L. Fauss, et ux, by Deed dated November 16, 1962, recorded in Deed Book No. 471, at page 457), said stake being 200 feet east on Blair Avenue from northeast corner of Lot No. 7 of Blair Park Addition No. 1 as recorded in Plat Book No. 12 at page 31; thence south along Faussás east line, 150 feet to north line of Park View Drive; thence N. 56õ 01á E. 80 feet, more or less, along north line of Park View Drive to a point; thence North on line parallel to Faussás east line, 1560 feet, more or less, to south line of Blair Avenue; thence S. 56õ 01á W. 80 feet, more or less, along south line of Blair Avenue to place of beginning.

 

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 130 Blair Avenue, Mineral Wells, WV 26150.

 

AND BEING the same real estate which was conveyed to Retro Canyon, LLC, by Deed dated March 25, 2004, from Claradon L. Ott, Geneva M, Ott, James L. Ott and Sandra K. Ott, and recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 1064 at Page 680.

 

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in âAS ISã condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
