The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated August 11, 2016, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed of Trust Book 971, at Page 319, Richard Hicks and Tammy J. Hicks did convey unto Marc J. Slotnick, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse, in Fayetteville, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the New Haven District, Fayette County, West Virginia, and more particularly described as follows:

Beginning at a white oak at the edge of a road, S 28-00 E 243 feet to Route 6000 highway right-of-way; thence, with said right-of-way, S 74-30 degrees W 780 feet; thence, S 89-15 W 356 feet, thence N 87-30' W 200 feet; thence N 81-45' W 243 feet to a stake; thence leaving the highway right-of-way N 41-00' W 789 feet to a stake; thence N 69-20 degrees E 478 feet to a point in the edge of a road; thence with the meanderings of the road, S 75-00' E 363 feet, thence S 72-00' E 231 feet, S 77-00 E 528 feet, thence S 58-40 degrees E 396 feet to the beginning, containing 17.6 acre, more or less, and being the same property conveyed unto the party of the first party herein by deed of Keith H. Farrar, et ux, dated the 8th day of Aug 2016, to be recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, simultaneously with this instrument, this instrument is made subject to all lawful restrictions, reservations, covenants and conditions, made and contained in prior deeds in the chain of title to the above described real estate.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 169 Jim Neff Road, Hico, WV 25854.

AND BEING the same real estate which was conveyed to Richard Hicks and Tammy J. Hicks, by Deed dated August 8, 2016, from Keith H. Farrar and Elizabeth M. Farrar, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 741 at Page 104.

The above described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in "AS IS" condition. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
