NOTICE OF TRUSTEE’S SALE

Under authority of that certain Deed of Trust dated August 27, 2007, from Ramona G. Whitt and Howard F. Whitt to Karen Wimmer and Greg Morris, Trustees, of record in the office of the Clerk of the County Commission of Mercer County, West Virginia in Trust Deed Book No. 1120, at page 718, securing a promissory note in the principal amount of $66,520.20, payable to New Peoples Bank, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by New Peoples Bank, Inc., the undersigned Successor Trustee will offer for sale at the front door of the Mercer County Courthouse in Princeton, West Virginia on January 30, 2019 at 10:00 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, all that certain tract or parcel of real estate, together with the improvements thereon and appurtenances thereunto belonging, described as “Parcel 3” of the Dewey L. Whitt and Glenna T. Whitt division as shown on a plat bearing the legend, “PLAT OF SURVEY SHOWING 3 PARCELS DIVIDED FROM THE LANDS OF DEWEY L. WHITT & GLENNA T. WHITT EAST RIVER DISTRICT, MERCER COUNTY, LYING ON THE WATERS OF EAST RIVER 0.8 MILES NORTH OF WILLOWTON, WEST VA., SCALE: 1″ = 100′, APRIL 25, 2002, R. GARY SHIELDS, LAND SURVEYOR”, which map is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia as Microfilm Plat No. 14751, and which property is more particularly bounded and described as follows:

“‘BEGINNING at a 1/2 inch rebar in a 30 feet wide right of way as shown on said Map, a common corner with Parcel 2; thence with line of Parcel 2, N. 22deg. 07′ 45″ W. 280.48 ft. to a 1/2 inch rebar set on a 30 feet wide right of way; thence with said [right of way] N. 69deg. 55′ 30″ E. 300.00 ft. to a 1/2 inch rebar set; thence N. 84deg. 37′ 00″ E. 62.51 ft. to a 1/2 inch rebar set; thence with Curve C1 a chord bearing S. 43deg. 43′ 07″ E. a distance of 62.76 ft. to a 1/2 inch rebar set in a 30 feet wide road way; thence S. 07deg. 57′ 00″ W. 107.24 ft. to a 1/2 inch rebar set; thence Curve C2 as shown on said Map a chord bearing S. 35deg. 47′ 30″ W. a distance of 140.11 ft. to a 1/2 inch rebar set; thence S. 63deg. 38′ 00″ W. 52.66 ft. to a 1/2 inch rebar set; thence S. 59deg. 50’ 20″ W. 159.34 ft. to the place of BEGINNING containing 2.00 acres more or less.'”

And being the same property conveyed unto Howard F. Whitt and Ramona G. Whitt, husband and wife, by deed of Freeman Whitt and Mary Whitt, dated June 29, 2007, of record in said Clerk’s Office in Deed Book 913, at Page 286.
“‘The Grantors additional (sic) grant to the Grantees a right of way across the 30 feet wide roadway as shown on said Plat for ingress and egress as those roadways cross the lands of the Grantors.'”
Terms of the sale: cash on date of sale.
