INVITATION TO BID
Sealed bids for the North Portal Phase II Project near Coalton, West Virginia will be received by Save the Tygart Watershed Association at [email protected] until 12:00 Noon Eastern Time on Friday August 1st, 2025. The Bids will be publicly opened and read aloud at the DEP Fairmont Office (1000 Technology Drive Fairmont, WV) at that time.
The work will include: maintenance to existing acid mine drainage passive treatment system and construction of a final wetland.

West Virginia Code 21-11-2 requires that all Bidders desiring to perform contractual work in West Virginia must be duly licensed. All prospective Bidders shall be licensed prior to submitting their bid and shall include their contractor’s license number on their bid in accordance with the requirements of West Virginia Code 21-11-11.

Each Bid shall be accompanied by security in the form of a certified check or Bid Bond furnished by a solvent surety company authorized to do business in the State of West Virginia payable to the order of Save the Tygart Watershed Association in the amount of not less than five percent (5 %) of the total bid. The successful Bidder will be required to furnish a satisfactory Performance Bond and Labor and Material Payment Bond, both in the amount of at least one hundred percent (100%) of the Contract Price.

Digital addenda, if any, will be issued to only those whose names and addresses are on record as having obtained Bidding Documents.

A MANDATORY pre-bid conference will be held on the project site at 38.896170, -79.977731 on Monday July 28th, 2025. Bidders shall meet at 10:00 AM. Questions will be received until the end of the Pre-bid conference on July 28th.

Prevailing wages will not be required for this project.

Save the Tygart Watershed Association reserves the right to reject any and all bids and to waive any informality in the bidding.

To the Above-Named Respondents and other lawful claimants:
The object of the above proceeding is to condemn certain property of the Respondents, or in which the Respondents have an interest, for public purposes for a roadway, designated as Project No. S354-68-17.07 00, NHPP-0068(191)DTC, the property proposed to be condemned being a part of Parcel No. 2-1 and 2-2 of the Project, as designated in the set of plans or maps for the project available for review in the DOH offices of District 3 located in Parkersburg, WestVirginia.
The property to be condemned for the purpose aforesaid is more particularly described as follows:

CONSTRUCTION
EASEMENT

BEGINNING at a point in the division line between James M. McCutcheon and Rebecca Mae McCutcheon and Grants of Naples, Inc., said point being in the southern existing controlled access right of way line of West Virginia Route 68, Northbound (Ramp A) and 34 feet radiallyright of relocated West Virginia Route 68, Northbound (Ramp A) centerline at Station 102+98,Project S354-68-17.07 00, NHPP-0068(191)DTC, Wood County, West Virginia;
thence, easterly, meandering with said existing controlled access right of way line 44 feet,more or less, to a point 33 feet radially right of centerline at Station 103+44;
thence, southeasterly, continuing with said existing controlled access right of way line 19 feet, more or less, to a point in the southern proposed temporary construction easement line of West Virginia Route 68, Northbound (Ramp A), said point being 51 feet radially right ofcenterline at Station 103+52;
thence, southwesterly, with said proposed temporary construction easement line 42 feet,more or less, to a point in the division line between James M. McCutcheon and Rebecca Mae McCutcheon and Grants of Naples, Inc., said point being 63 feet radially right of centerline atStation 103+09;
thence, northwesterly, with said division line 31 feet, more or less, to the place of beginning and containing 1,032 square feet, more or less.
The tract of land hereinabove described is a portion of that same real estate conveyed unto Grants of Naples, Inc., from Russell J. Grant, Jr., by deed dated December 29, 2014, of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1223, at Page 285.

BEGINNING at a point in the eastern existing city right of way line of 2nd Street, said point being in the southern existing controlled access right of way line of West Virginia Route 68, Northbound (Ramp A) and 47 feet radially right of relocated West Virginia Route 68,Northbound (Ramp A) centerline at Station 104+19, Project S354-68-17.07 00, NHPP-0068(191)DTC, Wood County, West Virginia;
thence, northeasterly, meandering with said existing controlled access right of way line 43 feet, more or less, to a point 36 feet radially right of centerline at Station 104+63;
thence, easterly, continuing with said existing controlled access right of way line 50 feet,more or less, to a point 36 feet right of and at right angle to centerline at Station 105+13;
thence, southeasterly, continuing with said existing controlled access right of way line 48 feet, more or less, to a point in the northern existing city right of way line of Juliana Street, said point being 77 feet right of and at right angle to centerline at Station 105+38;
thence, southwesterly, meandering with said existing city right of way line 85 feet, more or less, to a point in the eastern existing city right of way line of 2nd Street, said point being 121 feet radially right of centerline at Station 104+64;
thence, northwesterly, meandering with said existing city right of way line 84 feet, more or less, to the place of beginning and containing 5,907 square feet, more or less.

The above-named Respondents are hereby notified:
1. that the above-styled condemnation proceeding was instituted in the Circuit Court of Wood County on or about July 2, 2025, to take and appropriate the above-described propertyfor the purposes aforesaid;
2. that you may serve upon Ashley D. Wright, West Virginia Division of Highways,1900 Kanawha Boulevard, East, Building 5, Room A-517, Charleston, West Virginia, 25305, ananswer to the Petition filed herein;
3. that a copy of the Petition may be obtained from the Clerk of the Circuit Court ofWood County;
4. that a hearing to
determine the right of the Petitioner to take, appropriate and use the above-described land will be held on the 18th day of August, 2025 at 11:30 a.m. before the Honorable Judge Wharton of Wood County at the Wood County Judicial Building, 2 Government Square, Parkersburg, West Virginia, or as soon thereafter as counsel may be heard;
5. that Land Commissioners may be selected, whose purpose will be to determine justcompensation for the land proposed to be taken and for damages, if any, to the residue, and
6. that any and all other proceedings may be held and had as may be proper, at which time and place you, and each of you, are hereby notified to be present to protect your interests insaid proceeding.
