NOTICE OF TRUSTEE’S SALE

 

Under and by virtue of the authority vested in the undersigned Trustee, by that certain Substitution of Trustee dated July 19, 2016, of record in the Office of the Clerk of the County Commission of  Wood County, West Virginia, in General Lien Book 1927, at page  772, and by that certain Deed of Trust dated February 20, 2007, executed by Keith Eric Morris, securing Williamstown Bank, Inc., formerly known as Williamstown National Bank, of record in the aforesaid Clerk’s Office in General Lien Book 1413, at page 728, and said Deed of Trust providing that the Trustee on being required so to do by the holder of the Promissory Note secured by said Deed of Trust, should sell the hereinafter described at public auction, and default having been made in the payment of the indebtedness secured thereby and having been requested so to do, the undersigned will sell at public auction on

 

Wednesday, October 19, 2016, at 10:00 o’clock a.m.,

 

at the front door of the Wood County Courthouse in Parkersburg, West Virginia, that certain real estate situate in the City of Vienna, County of Wood, and State of­­­­ West Virginia, more particularly bounded and described as follows:

 

FIRST TRACT: BEING all of Lot No. 54 of A. T. Smith’s Subdivision No. 2 to the City of Parkersburg, now Vienna, as laid down and described on a plat of said subdivision of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book 1, at Page 26, to which said plat reference is hereby expressly made for a more particular and complete description of the real estate herein.

 

Prior Reference: Deed Book 810, at Page 140; Will Book 129, at page 927

 

SECOND TRACT: BEGINNING at a stake on the East side of Charles Street (Grand Central Avenue) 50 feet North of the intersection of Smith and Charles Streets (31st Street and Grand Central Avenue); thence in an Easterly direction parallel with Smith Street (31st Street), 122.95 feet to a stake; thence at right angles in a Northerly direction, 50 feet to a stake on a 15 foot alley; thence with said alley in a Westerly direction, 122 feet to Charles Street (Grand Central Avenue); thence with Charles Street (Grand Central Avenue) in a Southerly direction 50 feet to the place of beginning, being the Northern one-half of Lots Nos. Fifty-Six (56) and Fifty-Eight (58) of the A. T. Smith’s Subdivision No. 2, as fully shown and described on a plat of said Addition, of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book No. 1, at Page 26.

There is expressly excepted and reserved from this conveyance all of the oil, gas and other minerals, in and underlying the parcel of land hereby conveyed, heretofore reserved in prior deeds.

 

There is excepted from the above parcel that certain tract conveyed unto the West Virginia Department of Highways, a corporation, from Peggy J. Morris and Edgar W. Morris, her husband, by Deed dated December 31, 1986, and recorded in the aforesaid Clerk’s Office in Deed Book 843, at Page 731, more particularly described as follows:

 

Beginning at a stake on the east side of Grand Central Avenue (Charles Street) fifty (50) feet north of the intersection of 31st Street (Smith Street) and Grand Central Avenue (Charles Street); thence in an easterly direction and parallel with 31st Street (Smith Street) S. 64õ E. 12.01 feet to a pipe set; thence S. 27õ 40’ W. 50.01 feet to a pipe set in the easterly line of a 15 foot alley; thence in a westerly direction N. 64õ W. 12.51 feet; thence in a southerly direction fifty (50) feet, more or less, to the place of beginning.

 

TERMS OF SALE: Said property will be sold for cash in hand on the day of sale, or acceptable letter of credit, by auction to the highest bidder. The sale shall be further subject to the following:

 

(1) Real estate taxes delinquent, due and payable or to become due and payable;

 

(2) Any statutory lien or liens that have priority over the subject deed of trust that may affect the property;

 

(3) Any and all validly existing and continuing covenants, conditions, restrictions, reservations, easements and rights-of-way of record in the chain of title to the property or affecting title to the property;

 

(4) Such matters as could be ascertained by a current survey or physical inspection of the property;

 

(5) The property will be sold AS IS, WHERE IS, in its present condition with all faults and defects, if any, and without any warranty express or implied.

 

Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale.
