NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated March 18, 2008, executed by Borrower(s), Patricia I Evans, to David G. Palmer, the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1483, at Page 24.  At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1117 Stadium Dr, Parkersburg, WV 26101.  WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 2, 2017, of record in the Clerk’s Office in Book 1998, Page 915.  The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Parkersburg District, Wood County, West Virginia, and being more particularly described as follows:

 

All those certain lots, tracts or parcels of land lying and being situate in the City of Parkersburg, Wood County, West Virginia, and more particularly bounded and described as follows:

 

FIRST TRACT:

Beginning at a point in the northerly line of Stadium Drive, at the southeast corner of Lot Number 7 of John W. Dudleyás Addition to the City of Parkersburg, as extended by a Quit Claim Deed executed by the City of Parkersburg to Minnie E. Johnson, dated the 18th day of July, 1929, and of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book Number 200, at Page 163; thence in a northerly direction with the easterly line of said Lot Number 7, Seventy five feet to a point in said line; thence in a westerly direction and paralleling the northerly line of Stadium Drive, Fifty feet to a point in the westerly line of said Lot Number 7; thence with the westerly line of said Lot Number 7, in a southerly direction, Seventy five feet to the line of Stadium Drive; thence with the northerly line of Stadium Drive, Fifty feet to the place of beginning, and being Seventy five feet of the westerly end of Lot Number 7 of Dudleyás Addition to the City of Parkersburg which said lot is shown on a Plat of said addition of record in the aforesaid Clerkás Office in Deed Book Number 71, at Page 506 and to which Plat so recorded reference is here had for a more particular description of said lot.

 

TRACT TWO:

Beginning at a point in the westerly line of Lot Number 6 of the John W. Dudleyás Addition to the City of Parkersburg, which said point is 77.79 feet southerly from the southerly line of 24th Street (formerly called Covert Street); thence with the westerly line of said Lot Number 6, 72.21 feet to the southwesterly corner of said lot; thence at right angles and toward Dudley Avenue, 50 feet to a point; thence at right angles and in a northerly direction and parallel with Dudley Avenue, 72.65 feet to a point; thence in a westerly direction and parallel with Stadium Drive, 50 feet, more or less, to the place of beginning, being the southerly portion of Lot Number Six (6) in John W. Dudleyás Addition to the City of Parkersburg.

 

ALSO the following real estate abutting on what is known as Stadium Drive, to-wit:

Beginning at the southwesterly corner of that certain lot known as Lot Number 6 in John W. Dudleyás Addition to the City of Parkersburg; thence in a southerly direction with the westerly line of said lot extended, 2.79 feet to the northerly line of Stadium Drive; thence with northerly line of Stadium Drive, in an easterly direction 50 feet, more or less, to the easterly line of said lot extended; thence in a northerly direction 2.35 feet to the southeasterly corner of said Lot Number 6; thence with the southerly line of said lot in a westerly direction, 50 feet to the place of beginning; and being a strip of land lying between the southerly line of said Lot Number 6 and the northerly line of Stadium Drive.

Being the same property conveyed to Patricia I Evans by the Deed dated March 18, 2008 and recorded in Deed Book 1125 at Page 415 in the Office of the Clerk of the County Commission of Wood County, West Virginia.

 

TERMS OF SALE:

 

1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Π11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
