NOTICE OF TRUSTEE’S SALE
Notice is hereby given, that the undersigned Substitute Trustee, by the virtue of the authority vested in it by that certain Deed of Trust dated May 14, 2020, recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed of Trust Book 1603, at Page 568, executed by Lina R. Lynch (and later assumed by Stephanie A. Rake), to Robert D. Lewis, State Director of the Rural Housing Service for the State of West Virginia, or its successor agency, and the successors in office as State Director or Acting State Director, as Trustee, for the benefit of the United States of America, acting through the Rural Housing Service or successor agency, United States Department of Agriculture, will offer for sale at public auction at the front door of the Wood County Courthouse, in Parkersburg, West Virginia, on
January 29, 2020 at 5:06 p.m.
The following described property, with its improvements, easements and appurtenances thereunto belonging, situate in the Williams District, Wood County, West Virginia, and more particularly described as follows:
BEGINNING at a point at the northern corner of Lot Number 7 of Parker’s Towne Subdivision of record in Deed Book 16, at Page 23; thence with said Lot 7, S. 65 deg. 22′ 40″ E. a distance of 38.15′ to a capped rebar set; thence with the common line of Lots 6 and 7 of said subdivision S. 14 deg. 35′ 56″ E. a distance of 154.09′ to a drill hole set in the right-of-way line of Rubles Court; thence with said Rubles Court the chord of a curve having a delta angle of 54 deg. 50′ 32″ and radius of 38.00′, S. 47 deg. 59′ 01″ W. a distance of 35.00′ to a capped rebar set; thence leaving Rubles Court and with the common line of Lots 7 and 8 of said subdivision, N. 69 deg. 26′ 28″ W. a distance of 118.80′ to a capped rebar set; thence with the outside lines of Lot 7, N. 10 deg. 59′ 40″ E. a distance of 88.70′ to a capped rebar set thence, N. 38 deg. 07′ 13″ E. a distance of 75.82′ to the point of beginning, and containing 16,205.768 square feet. Being all of Lot Number 7 of Parker’s Towne Subdivision of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 16, at Page 23.
This conveyance is made subject to those certain covenants and restrictions contained in the Declaration of Covenants and Restrictions, dated October 20, 1975, of record in the aforesaid Clerk’s Office in Deed Book 660, at Page 187.
This conveyance is also made subject to all restrictive covenants set forth on the plat of said Subdivision of record in the aforesaid Clerk’s Office in Plat Book 16, at Page 23.
ALSO, by the acceptance of this conveyance, the Grantees herein, their heirs and assigns, promise and agree to pay to Parker’s Towne Development Corporation, its successors and assigns, the sum of Seven ($7.00) Dollars per month sewerage service fee until such time as the Public Service Commission of West Virginia shall set and determine the rates therefore; and thereafter the Grantees shall pay the sewerage fees established by said Commission. This is also a covenant running with the land.
At the time of the execution of the Deed of Trust, the property was reported to have a mailing address of 24 Rubles Court, Parkersburg, WV 26104.
AND BEING the same real estate conveyed to Lina R. Lynch by Deed dated May 11, 2010 from Adria D. Mosser, Jr., Robert Scott Yates, and Sue Ellen Yates and recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia in Deed Book 1153, at Page 749. Said Line R. Lynch passed away from this life in 2010 and title vested in Stephanie A. Rake.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
5) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale. Title will be conveyed by Trustee’s Deed upon payment of balance. There will be no refund granted of any amount if the third party purchaser elects not to purchase the property for any reason.

CONTINUANCE OR ADJOURNMENT OF SALE:
The Trustee or his assigns has the right to continue the sale or to adjourn the sale for a time or from time to time without further notice other than oral public announcement at the time and place appointed for such sale or at any continuance or adjournment thereof and correction made on the posted notices, which continuance shall be in the sole discretion of the Trustee.
