ORDER CONFIRMING THE
ACTIONS OF THE
COMMISSIONERS OF
ELECTION FOR PRECINCT 120 AND CHANGING THE LOCATION OF THE POLLING PLACE FOR PRECINCT 120 PALATINE
MAGISTERIAL DISTRICT OF MARION COUNTY,
WEST VIRGINIA

WHEREAS, pursuant to Chapter 3, Article 1, Section 5, of the revised Code of West Virginia the County Commission of Marion County, shall utilize precincts for the basic territorial election unit; and

WHEREAS, the County Commission shall divide each Magisterial District of the County into election precincts, shall number the precincts, and shall designate one voting place in each precinct which shall be established as nearly as possible at the point most convenient for the voters of the precinct; and

WHEREAS, pursuant to West Virginia Code Chapter 3, Article 1, Section 7, the County Commission of any county may change the location of any polling place whenever the public convenience may require it; and

WHEREAS, the National Guard Armory which has in past elections been used as the polling place for Precinct 120 in the Palatine Magisterial District of Marion County is not available for use during the May 14th, 2024 Primary Election; and

WHEREAS, the unavailability of the National Guard Armory was not made known to the Clerk of the County Commission in a timely manner to assure compliance with West Virginia Code Chapter 3, Article 1, Section (b) or (g); and

WHEREAS, In accordance with West Virginia Code Chapter 3, Article 1, Section 7(f) of the West Virginia Code, as amended, the commissioners of election for that precinct have determined to hold the May 14, 2024 Primary election at the nearest place which could be secured for such purpose, namely the Fairmont First Church of the Nazarene located at 1604 Morgantown Avenue; Fairmont, West Virginia, and

WHEREAS, the change in location of the polling place for Precinct 120 in the Palatine Magisterial District of Marion County, shall be a permanent change.

It is therefore ORDERED that the County Commission of Marion County does hereby confirm and ratify the actions of the commissioners of election for Precinct 120 for the May 14, 2024 primary election.

It is further ORDERED that the polling place for Precinct 120 in the Palatine Magisterial District of Marion County for all future elections shall be the Fairmont First Church of the Nazarene located at 1604 Morgantown Avenue; Fairmont, West Virginia.

It is further ORDERED that the Clerk of the County Commission of Marion County shall give notice of such change by publishing notice of this change as a Class II-O Legal Advertisement in compliance with provisions of Article 3, Chapter 59, of the West Virginia Code, as amended and by posting notice of such change on election day on the door of the previous polling place describing the location of the newly established polling place and shall mail written notification to all registered voters affected by the change.

It is further ORDERED that the Clerk of the County Commission of Marion County shall make known by proclamation to voters present at the time for opening the polls, and by posting a notice at or near the entrance of the first named polling place, the location at which the election will be held.

The Clerk of the County Commission shall place a copy of this Order in the Election Precinct Record Book.

PUBLIC NOTICE OF
BLASTING OPERATIONS

Notice is hereby given that Greenbrier Minerals, LLC, 100 Bill Baker Way, Beckley, WV 25801, Ph. No. (304) 583 – 5933, Permit Nos. O-0019-84, O-0098-83, S-5012-10, S-5033-95, S-5006-15, S-5007-09, S-5014-10, S-5004-17, S-5004-22 and U-5013-11 situated in Triadelphia District of Logan County and/or Washington District of Boone County and/or Oceana District of Wyoming County approximately 3.3 to 5.5 miles northeast of Lorado, 1.2 to 2.7 miles northwest of Lorado, and 2.0 miles southeast of Lorado, will be conducting blasting activities in accordance with all State and Federal Laws and as approved by the Department of Environmental Protection.

Blasting activities will occur Monday through Saturday from “sunrise to sunset”. No blasting shall be conducted on Sunday. Blasting is to commence on 04/07/24 and continue through 04/06/25.

Ten minutes prior to and immediately after each blast, all across to the specific area will be safeguarded from unauthorized entry. The warning signal prior to each blast shall be from a siren audible to at least one-half mile from the blast. The warning will be given three (3) minutes prior to detonation and will consist of three (3) short blasts of five (5) seconds duration with five (5) seconds between each blast. The all-clear signal shall be one long blast from a siren of twenty (20) seconds duration.

Blasting shall be conducted in such a way so as to prevent adverse impacts to the public or the environment.

Blasting activities will not be conducted at times other than those announced in the blasting schedule except in the event of an emergency situation where rain, lightening, or other atmospheric conditions, or operator or public safety requires unscheduled detonations.
