TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated March 16, 2010, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5038, at Page 8973, Gerald A. Agee and Carloyn Agee did convey unto Richard A. Pill, Trustee, certain real property described in said Deed of Trust; and default having been made under the aforementioned Deed of Trust, and the undersigned Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on

April 15, 2024, at 1:00 PM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Shady Spring District, Raleigh County, West Virginia, and more particularly described as follows:
The following described property located in the County of Raleigh, State of West Virginia, to-wit:

BEGINNING at a stake on the eastern right-of-way line of West Virginia Secondary Route No. 42, a corner to property conveyed to Melzah W. Moore by the part of the first part by deed dated the 2nd day of July, 1974; thence with the eastern right-of-way line of West Virginia Secondary Route No. 42 N. 4 degrees 44’ W. 39.00 feet to a stake; thence continuing with said West Virginia Secondary Route No. 42, N. 24 degrees S. 5’ E. 231.30 feet to a stake on the property line of the Raleigh County Board of Education; thence with the property line of the Raleigh County Board of Education S. 44 degrees 55’ E. 126.50 feet to a stake, a corner to the Melzah W. Moore property; thence with the Melzah W. Moore line S. 45 degrees 40’ W. 291.6 feet back to the point of beginning, containing 0.74 acre, more or less; and being more particularly set out on a map and identified as TRACT NO. 5, which map is entitled “MAP SHOWING A PORTION OF G.C. & MINNIE MOORE’S ORIGINAL 5.29 ACRE TRACT”, and attached to and recorded with that certain deed from Minnie Moore, single, to Billy R. Moore dated the 2nd day of July, 1974, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 542, at Page 428.

Being the same property conveyed to Gerald A. Agee, unmarried by deed from Nancy L. Holly, widow, dated 05/24/2000, filed 05/31/2000 and recorded in Deed as Inst. No. 50024124 in Book 5002, Page 4124 in Raleigh County records.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 140 Old Cline Road, Ghent, WV 25843.

AND BEING the same real estate which was conveyed to Gerald A. Agee, by Deed dated May 24, 2000, from Nancy L. Holly, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5002, at Page 4124.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
